Compliance requirements

The bidder must not be subject to mandatory exclusion grounds, including convictions of the bidder or relevant representatives for participation in a criminal organisation, breach of professional duties, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; unlawful employment of foreign nationals or breaches of employment conditions; illegal use of child labour or trafficking in human beings; or outstanding national taxes, duties, environmental charges or social security contributions. The contracting authority may also exclude a bidder that has seriously or repeatedly breached important obligations under a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has submitted false information or failed to provide required information or additional documents concerning the qualification requirements. Participation is not permitted for entities established or resident in the Russian Federation or the Republic of Belarus. Materials, equipment, goods and components originating from or produced in Russia or Belarus may not be installed or used; the contracting authority may request certificates of origin. The bidder must provide the required confirmations and, where applicable, the documents proving compliance.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the procurement during the 60 months preceding the commencement of the procurement. At least one of these contracts must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the contracting party’s representative and contact details, and, for public contracts, the reference numbers. Evidence of proper performance must be provided at the contracting authority’s request unless the information can be obtained from public or private databases without significant expense. The bidder must have a person with valid switching rights for work-related switching operations in the 0.22–20 kV electricity network, excluding regional and distribution substations. This person must be registered in Elektrilevi’s partner portal before the tenders are opened. For low-voltage works only, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required where applicable. The bidder must have a person responsible for the work operation, registered in Elektrilevi’s partner portal before the tender submission deadline. The team must also include a person leading the electrical works who has valid A-level competence or a qualification corresponding to at least level 6 under the Professional Qualifications Act, holds the relevant evidence by the time of submission, and is registered in the partner portal before the deadline. The tender must comply with all procurement documents; conditional tenders or tenders containing additional conditions are not permitted. The price must be submitted using the required price table, with all unit-price fields completed. The bidder must provide the names, positions and contact details of the contract signatory or signatories and the contract-performance contact person. A power of attorney must be included if signing authority does not arise from the articles of association. Joint bidders must appoint an authorised representative and submit the relevant power of attorney.
