Compliance requirements

The bidder, its administrative, management or supervisory body members, and persons authorised to represent or control it must not be subject to grounds for exclusion. Checks cover final convictions within the previous five years for participation in a criminal organisation, corruption, fraud, terrorism or offences related to terrorist activity, money laundering or terrorist financing, and illegal child labour or human trafficking, as well as whether any exclusion period imposed by a court judgment is still in force. Exclusion may also apply for enabling a foreign national residing in the country without legal grounds to work, or for allowing breaches of the conditions for a foreign national’s employment in Estonia; the procurement passport identifies this as a mandatory ground for exclusion. The bidder must have no outstanding taxes or social security contributions in its country of establishment or the contracting authority’s country. According to the information provided, tax debt below EUR 100 or debt under a payment arrangement is an exception for which the tax authority does not issue a tax-debt certificate. Another ground for exclusion is that awarding the contract would breach an international sanction or a sanction imposed by the Government of the Republic of Estonia. Qualification criteria and exclusion grounds

The bidder must provide a technical description of the proposed solution, including a final list of all components offered—hardware, software, licences and manufacturer maintenance packages—and the applicable warranty and maintenance terms. The bidder must also submit a certificate issued by the equipment manufacturer proving its right to resell the items covered by the procurement in Estonia. The bid must comply with the tender documents and be unconditional. If an equivalent solution is offered, the bidder must explain the equivalence and provide supporting evidence. In a joint bid, the joint bidders must appoint an authorised representative from among themselves and include a power of attorney. Any information identified as a trade secret must be accompanied by reasons for that designation. The bid price and figures used to assess the award criteria may not be designated as trade secrets. If the bid is successful, the bidder must provide the name of the contract signatory and the basis for their authority to sign, as well as the name, telephone number and email address of the contract contact person.
