Compliance requirements
A bidder must be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of integrity duties or corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals or violations of the rules governing their employment, child labour or human trafficking. Exclusion is also mandatory for outstanding tax, social security or environmental levy debts, or if awarding the contract would breach an international or Estonian government sanction. The contracting authority may also exclude a bidder for a serious or persistent breach of a previous public contract, or for providing false information or failing to submit requested information or documents. The bidder must submit the confirmations in Appendix 5; in a joint bid, each consortium member must submit the applicable confirmations.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register of an EU or EEA member state, or a state that is a party (not merely an observer) to the WTO Government Procurement Agreement, where registration is required by the law of its country of establishment. On request, evidence of registration must be provided; Estonian bidders need not submit a registry certificate copy.
Financial capacity: In each of the last three completed financial years before the tender began (2023, 2024 and 2025), the bidder must have achieved net revenue of at least EUR 300,000 excluding VAT from nationwide IT/telecommunications network maintenance and fault repair services. The data must be given in Appendix 5, with supporting accounts or other evidence provided on request. If the bidder relies on another entity’s financial resources, it must identify that entity and submit its confirmations using Appendix 5.1.
Experience and service capacity: During the 36 months before the tender began, the bidder must have completed without material breach at least one telecommunications cable and/or active equipment maintenance contract worth at least EUR 100,000 excluding VAT. The contract must have included maintenance of communications systems/network equipment hardware and mobile communications systems, as well as 24/7 fault response and resolution. Contract details must be provided in Appendix 5; the client’s confirmation must be supplied on request. By the start of the framework agreement, the bidder must own or have the right to use a service centre operating 24/7, including public holidays and rest days, and provide the details in Appendix 5.
The bidder must have implemented an EVS-EN ISO 9001-compliant or equivalent quality management system and provide the relevant details in Appendix 5; the certificate or equivalent evidence must be provided on request.
The contract team must have at least eight members: at least six specialists responsible for equipment fault repair and at least two specialists responsible for tower maintenance. One person may fill only one of these roles. At least two fault-repair specialists must cover each work area listed in Appendix 1.1, with at least six such specialists overall. The team must enable arrival in every work area within two hours, 24/7/365. At least one team member must be a TDM systems expert with experience administering Keymile UMUX systems. All team members must have low-voltage systems training and relevant work experience. At least two tower-maintenance specialists must have telecommunications experience during the preceding 36 months, low-voltage systems authorisation and relevant experience during that period, and authorisation and experience for work at height on towers up to 100 metres. The bidder must provide the team list in Appendix 7, specialist CVs in Appendix 8, and the required training certificates and proof of the TDM expert’s status. For specialists who are not the bidder’s employees, a signed confirmation of their availability and ability to participate in the contract is required.
A valid ISO/IEC 27001 certificate, or qualifying equivalent evidence covering IT and/or telecommunications maintenance or support services, earns 15 evaluation points. It must be valid by the submission deadline and maintained throughout the framework agreement; the bidder must submit it or confirm its absence with the offer. The bidder must submit the participation declaration in Appendix 2, a price in euros in the required structure, and evidence of equivalence where applicable. Joint bidders must appoint an authorised representative and confirm joint and several liability in a power of attorney signed by all members, using Appendix 4.
