Compliance requirements

The bidder, its management or supervisory board members, and its authorised representatives must not have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism or terrorist-related offences, money laundering or terrorist financing, or illegal employment of children or human trafficking. Where relevant, details of the conviction and any measures taken to restore reliability must be provided. The bidder must not have outstanding tax or social security payment obligations. If such a breach exists, the bidder must describe the breach and the payment of the obligations or the conclusion of a binding settlement. Grounds for exclusion may also include bankruptcy, insolvency or liquidation proceedings, assets administered by a liquidator or court, suspended business activities, serious professional misconduct, agreements restricting competition, conflicts of interest, serious or repeated breaches of previous public contracts, early termination of previous contracts, damages or penalties, submission of false information, withholding information or failure to provide requested documents, and breaches of environmental, social or labour-law obligations. The contracting authority will also check breaches related to enabling the employment of a foreign national staying in Estonia without a legal basis, the application of international sanctions, statutory participation restrictions and convictions for tax offences. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. Where the international threshold applies, subcontractors or suppliers accounting for more than 10% of the contract value must not be Russian nationals, residents or entities established in Russia, nor entities owned or controlled by such persons. Joint bidders are jointly and severally liable for contract performance.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register of its country of establishment where registration is required. Lot 1 – furniture: the bidder’s average net turnover for the last three financial years completed before the start of the procurement, covering 01.01.2023–31.12.2025, must be at least EUR 300,000 per year. Lot 2 – window coverings: the average net turnover for the same period must be at least EUR 100,000 per year. If the bidder has operated for less than three years, the average is calculated over its period of activity. Turnover data must be provided in the European Single Procurement Document and, where necessary, supported by additional evidence. For Lot 1, during the 36 months preceding the start of the procurement, the bidder must have properly completed contracts for the sale and delivery of furniture or furnishings to legal persons with a total value of at least EUR 250,000 excluding VAT, including at least one contract worth at least EUR 150,000 excluding VAT. For Lot 2, during the same period, the bidder must have completed contracts for the sale and delivery of window coverings with a total value of at least EUR 50,000 excluding VAT, including at least one contract worth at least EUR 30,000 excluding VAT. The goods must have been delivered and accepted by the client; the warranty period may still be ongoing. The European Single Procurement Document must include contract descriptions, values, dates and client contact details, with further evidence provided upon request. The bid must be submitted using the relevant Form 4 price schedule and the structure specified in the electronic procurement system. Conditional and partial bids are not permitted. The bidder must confirm compliance with the technical description, offer a warranty period, confirm that the products may be sold in the European Union and include Estonian-language maintenance and user manuals, and provide details of authorised representatives or confirm that none exist. If an equivalent product is offered, the equivalence must be explained and the necessary evidence attached. Where the bidder relies on another entity’s capacities, that entity’s European Single Procurement Document and consent must be submitted; a joint bid must include a power of attorney.
