Compliance requirements
The bidder must declare whether it or any relevant manager, representative or supervisory body member has been convicted within the last five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, arrangements with creditors or suspended business activity; serious professional misconduct; agreements that distort competition; conflicts of interest or involvement in preparing the procurement where the situation cannot otherwise be remedied; significant or repeated failures under previous contracts, including early termination or damages; and false or misleading information, omitted information, failure to provide requested documents, or improper attempts to obtain confidential information or influence the procurement. National grounds also cover enabling a foreign national to work unlawfully, being subject to international sanctions, and relevant tax offences. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
For each lot, the bidder must submit a technical offer based on the technical specification in Annex I and price information in the prescribed structure. Conditional bids are not permitted. The bid must identify the person authorised to sign the contract and the contract contact person, including their contact details; a power of attorney must be provided where applicable. If the bidder is not the product manufacturer, it must submit the manufacturer's or authorised marketing authorisation representative's written consent to the offer, together with confirmation that the proposed doses will be immediately and continuously available throughout the contract term. The bidder must identify any trade secrets in the bid and explain why they qualify as such; prices and other specified figures used to evaluate bids may not be designated as trade secrets. The bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. It must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia, are more than 50% directly or indirectly owned by such persons or entities, or act on their behalf or under their instructions. The available documents specify no financial or experience thresholds or award criteria.
