Compliance requirements
The bidder must confirm that none of the exclusion grounds apply. These include final convictions within the relevant period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The bidder must also not have unpaid taxes or social security contributions, bankruptcy or insolvency proceedings, liquidation, suspended business activities, a serious breach of professional conduct, agreements restricting competition, an unavoidable conflict of interest, involvement in preparing this procurement that creates an undue advantage, or serious or repeated breaches of previous public contracts resulting in early termination, damages or penalties. Providing false information, withholding required information, failing to submit requested documents, or seeking confidential information or improperly influencing the contracting authority may also lead to exclusion. National exclusion grounds additionally concern unlawful employment of foreign nationals, international sanctions, and convictions for tax offences. The bidder must provide the required confirmations and, where applicable, information about the circumstances, available evidence and any reliability-restoration measures.
Qualification criteria and exclusion grounds
The bidder must submit a bid that fully complies with the tender documents and may not submit a conditional bid. The bid must include the name, position and signing authority of the person who would sign the contract, as well as the name, telephone number and email address of the contract contact person. The price must be submitted using the structure specified in the price and evaluation schedule. The bidder must provide the technical description based on Annex I to the tender documents and complete the required product information. If the bidder is not the manufacturer, it must submit written consent from the manufacturer or marketing authorisation holder, together with confirmation that the offered radiopharmaceutical doses will be immediately and continuously available throughout the contract period. The bidder must identify any trade secrets and justify that designation; the bid price and other legally non-confidential evaluation-related figures may not be classified as trade secrets. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. It must also confirm that subcontractors or suppliers exceeding 10% of the contract value are not Russian citizens, residents or entities established in the Russian Federation, entities more than 50% owned by such persons or entities, or representatives acting under their instructions.
