Compliance requirements

The bidder and relevant persons with management, supervisory or representative powers must not have final convictions within the applicable period—generally the preceding five years—for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and human trafficking offences. The grounds also cover unpaid taxes or social security contributions, subject to the stated national rules, including the Estonian exception for tax debts below EUR 100 or debts whose payment has been rescheduled. Other grounds include breaches of environmental, social or labour-law obligations; bankruptcy, liquidation, insolvency proceedings, creditor arrangements, court or liquidator administration of assets, suspended business activity, or comparable situations; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest; involvement in preparing this procurement where the resulting competitive advantage cannot otherwise be remedied; significant or repeated failures under previous public contracts resulting in early termination, damages or comparable sanctions; and false or misleading information, withheld information, failure to provide required documents, or improper attempts to influence the procurement or obtain confidential information. National grounds also cover enabling a foreign national to work without legal basis or in breach of applicable employment conditions, including paying below the statutory wage; relevant international or Estonian sanctions; convictions for tax offences; any applicable local tax debt grounds; and restrictions on participation based on the bidder’s place of residence or establishment. The tender documents also prohibit participation by undertakings established in Russia or Belarus, or reliance on their resources. Where legally available for a ground, the bidder may submit evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 500,000 in each of the last two financial years completed by the start of the procurement. The bidder must provide information on those turnovers; if the information is not publicly available to the contracting authority, it must provide the requested financial statement extracts or other evidence of turnover upon request. Within the 36 months preceding the procurement, the bidder must have properly performed at least three contracts involving maintenance of security and low-voltage systems in buildings with more than 3,000 m² of enclosed net floor area. Each contract must cover at least six consecutive months of maintenance, including activities under EVS 807 codes 248 and 281. The contract need not have ended, but the required six months must have been properly performed. The bidder must list the contracts and provide descriptions, values, dates, and client details, including contact information and, for public contracts, reference numbers. Framework-agreement experience may be demonstrated using contracts awarded and performed under that framework agreement. The project manager must have at least secondary education, Estonian language skills at B2 level or higher in speaking and writing, and either experience managing maintenance of security and low-voltage systems for at least two buildings with more than 1,000 m² of enclosed net floor area each, with at least six consecutive months of management for each service during the 36 months preceding publication of the contract notice, or a Level 5 Security Systems Responsible Specialist certificate with the competence for installation and maintenance of fire alarm systems, or an equivalent qualification. The bidder must undertake to provide the project manager’s details before the contract is signed. The bidder must submit the price schedule using the required structure and the price statement in Annex 4. Conditional tenders are not permitted, and submission confirms acceptance of the procurement-document conditions. Where equivalence is relied upon, the bidder must explain it and provide supporting evidence. Joint bidders must appoint an authorised representative and include their power of attorney. The bidder must identify and justify any claimed trade secrets; tender prices and other specified evaluation-related numerical information may not be treated as trade secrets.
