Compliance requirements
The bidder must confirm that no exclusion grounds apply to it or to any member of its administrative, management or supervisory body, or any person authorized to represent it. These grounds include final convictions within the last five years for participation in a criminal organization, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing, and illegal use of child labour or human trafficking.
Other possible grounds for exclusion include failure to pay taxes or social security contributions, breach of an international sanction, a conviction for a tax offence, local tax arrears in the contracting authority’s area, or breach of a participation restriction based on the bidder’s place of establishment or residence. Enabling a foreign national who is unlawfully present in the country to work, or breaching the conditions for a foreign national’s employment in Estonia, is a mandatory ground for exclusion. The stated threshold for tax and social security arrears is EUR 0; the Estonian tax authority does not issue a tax-debt certificate when the debt is below EUR 100 or payment has been deferred. In cases involving unpaid tax or contribution obligations, the bidder may describe how it has fulfilled those obligations or entered into a binding payment arrangement. If an exclusion ground applies and remedial measures are permitted for this procurement, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must be registered in the relevant business register.
During the three years preceding publication of the contract notice, the bidder must have properly completed at least one similar service contract. A similar service includes in-person training and related arrangements, such as providing venues, preparing information materials, registering participants, preparing training materials and organizing coffee breaks. The bid must state the client’s name, provide a brief description of the service and specify the contract performance period.
The bid must name at least one trainer with experience in local government waste management, waste economy or circular economy, or organized waste collection, as well as experience in adult training. The trainer must participate in performing the contract. The bidder must provide the trainer’s signed CV and written consent to participate in contract performance. The CV must include details of training or advisory services delivered during the last three years.
The bidder must submit a preliminary training plan stating the topics, the named trainer (and any additional trainers, if desired), the planned time allocation for each topic and the training methodology. The plan must also include a schedule for the entire contract period, with proposed dates and regions for the sessions. The exact venue must be agreed with the contracting authority no later than 30 days before each session. The preliminary training plan and methodology are an award criterion.
For a joint bid, the bidders must provide a power of attorney appointing an authorized representative. The bid must comply with the tender documents and be unconditional; its price must follow the structure specified on the award criteria sheet. Where relevant, equivalence must be explained and supported with evidence. References to standards and other specified items in the tender documents are understood to include “or equivalent”.
