Compliance requirements
The bidder may be excluded if it or a person authorised to represent, manage or control it has a relevant conviction within the preceding five years, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Grounds also include breaches of tax or social security payment obligations; bankruptcy, insolvency, liquidation, creditor arrangements, court- or liquidator-administered assets, suspended business activities; serious professional misconduct; agreements distorting competition; an unmanageable conflict of interest; involvement in preparing the procurement where this creates an advantage that cannot otherwise be remedied; serious or repeated failures under previous contracts resulting in early termination, damages or comparable sanctions; false or misleading information, withholding required information or documents, or improperly seeking confidential information; and breaches of environmental, social or labour obligations. National grounds include enabling the unlawful employment of a foreign national, being subject to applicable international sanctions, tax-related convictions, or being ineligible to submit a tender under a restriction based on the bidder’s place of establishment. The notice also asks bidders to confirm that taxes and social security contributions are paid; the stated threshold is EUR 0, with the notice explaining that tax arrears below EUR 100 or deferred debts are treated in accordance with the applicable national rules. Where permitted for this procurement, a bidder may provide evidence of remedial measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must submit the completed technical form and technical documentation demonstrating compliance with all mandatory requirements. The form must describe, among other things, the conditioning, weighing and QA/QC workflow under EVS-EN 12341:2023, including the 40 µg and 60 µg criteria and intermediate conditioning times; the microbalance’s readability, calibration uncertainty, maximum capacity, repeatability and linearity; the temperature and relative-humidity sensors’ measurement uncertainty and calibration; supported filter materials and holders and static-electricity neutralisation; software, data fields, export functions, user management and audit trail; installation and infrastructure requirements; and warranty, maintenance, calibration and fault-response arrangements. Answers must be verifiable against relevant references in a technical data sheet or manufacturer documentation. A bare statement such as “compliant” or “yes” is insufficient where supporting evidence is required. Technical documents may be submitted in Estonian or English; documents in another language must be accompanied by a translation into one of those languages. The contracting authority may request further explanations or documents.
The equipment must be delivered and installed within 9 months of contract signature at Marja tn 4d, Tallinn 10617. The warranty must last at least 24 months and cover necessary maintenance and repair work, spare parts and accessories without additional cost to the contracting authority, except for consumables and normal component wear. The availability of original spare parts and maintenance and repair support must be ensured for at least 5 years from installation.
The bidder must confirm that its tender complies with the procurement documents and, where equivalence is offered, explain and substantiate it. Conditional tenders are not permitted. For a joint tender, a power of attorney for the joint bidders must be included. The tender must identify any information claimed as a trade secret and explain that designation; the tender price and figures corresponding to award criteria may not be designated as trade secrets. The bidder must provide the names and personal identification codes of authorised representatives not visible to the contracting authority in the Estonian Commercial Register, or confirm that there are no such persons. The goods offered must not be subject to international sanctions or originate from a sanctioned region. During contract performance, subcontractors and suppliers must be established in Estonia, another EU Member State, an EEA contracting party or a World Trade Organization member party to the Government Procurement Agreement. In addition, Russian nationals, residents or entities established in Russia, and persons or entities owned or directed by them, may not account for more than 10% of the contract value.
