Ordering felling works on state-owned land (Land and Spatial Planning Board)

The bidder must confirm that none of the exclusion grounds applies to the company or relevant representatives. These grounds include final convictions within the last five years or continuing exclusion obligations for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. They also include breaches of tax or social security payment obligations; environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation, administration of assets by a liquidator or court, suspension of business, or similar situations; serious professional misconduct; agreements intended to distort competition; an unavoidable conflict of interest; involvement in preparing the procurement that created an unfair advantage; serious or repeated breaches of previous public contracts resulting in early termination, damages or comparable sanctions; false information, failure to provide required information or documents, attempts to obtain confidential information, or improper influence on the contracting authority. National exclusion grounds also cover enabling illegal employment of foreign nationals, being subject to an international sanction, convictions for tax offences, and lacking the right to submit a tender because of the bidder’s place of establishment. Tax and social security arrears are subject to a stated threshold of EUR 0; the notice also explains that an Estonian tax arrears certificate is generally not issued where the debt is below EUR 100 or payment has been deferred. Where permitted, the bidder may submit evidence of remedial measures demonstrating restored reliability. The bidder must provide the required answers and supporting information in the ESPD and be able to submit evidence on request.

The supplied documents do not specify a turnover threshold, minimum number or value of previous contracts, or other separate financial or experience requirements. The bidder must, however, meet the following qualification and compliance requirements: appoint an arborist with a valid professional certificate for the felling works and provide the person’s name and certificate number; comply with environmental requirements, including observing the bird-nesting protection period; hold valid liability insurance throughout the framework agreement and provide a copy of the policy before concluding the agreement; submit the completed unit-price form without alterations or additional conditions, enter all required prices in euros excluding VAT, and ensure that the calculated total matches the price shown in the evaluation sheet; submit an unconditional tender confirming acceptance of all procurement documents and the draft framework agreement; explain and substantiate equivalence where an equivalent solution is offered; provide the names and personal identification codes of authorised or managing persons not visible in the register, or confirm that there are none; and use only subcontractors and suppliers established in Estonia, another EU Member State, an EEA contracting state or a WTO Government Procurement Agreement party. For a joint tender, a power of attorney and a separate ESPD for each joint tenderer are required. The tenderer must also identify any trade secrets and justify that designation. The tender may cover up to 7 lots, and contracts may be concluded with one bidder for up to 7 lots.
