Compliance requirements
The bidder may be excluded if it or a person authorised to represent, manage or control it has a relevant final conviction within the last five years, or an exclusion period remains in force. The listed offences include participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. Where permitted for this procurement, the bidder may provide evidence of measures taken to restore its reliability.
Exclusion grounds also include unpaid taxes or social security contributions, enabling a foreign national to work without legal grounds or in breach of employment conditions, including payment below the statutory rate, and a contract that would breach an international or Estonian government sanction. A bidder may also be excluded if it is not entitled to participate under a restriction based on its place of establishment or residence. For tax and social security debts, the stated threshold is EUR 0; under Estonian rules, a tax-debt certificate is not issued for debts below EUR 100 (excluding interest not established by an administrative act) or where payment has been deferred.
Qualification criteria and exclusion grounds
The bidder must submit the completed price form with all service unit prices in euros, excluding VAT, rounded to two decimal places. The quoted unit prices may not exceed the corresponding prices in the bidder’s business customer price list in force on the submission deadline; the bidder must provide that price list for verification if requested. The relevant total from the price form must also be entered in the procurement system.
During service delivery, vehicles must meet the requirements of Minister of the Environment Regulation No. 6 of 16 February 2023: at least 23.1% of M1, M2 and N1 vehicles used must emit less than 1 g of CO2 per kilometre; at least 9% of N2 and N3 vehicles used must either emit less than 1 g of CO2 per kilometre or use alternative fuels. The bidder must confirm compliance with these minimum shares and requirements.
For a joint bid, the bidders must appoint an authorised representative and submit a power of attorney; a separate European Single Procurement Document must be submitted for each joint bidder. The bidder must identify any information in its bid claimed as a trade secret and explain why; bid prices and other numerical figures used for evaluating service bids may not be designated as trade secrets. The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions. The bidder must provide the names and personal identification codes of authorised persons who can represent, make decisions for or control the bidder but are not listed in the Commercial Register, or confirm that there are no such persons.
