Purchase of Corporate Clothing

Mandatory exclusion grounds apply if the bidder or a person authorised to represent, manage or control it has been convicted of specified serious offences, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, certain illegal employment offences, child labour or human trafficking. A bidder may also be excluded for outstanding tax, social security or environmental charge debts, or where it or a relevant representative is subject to international sanctions. Optional grounds include breaches of environmental, social or labour obligations; insolvency or liquidation; serious professional misconduct; anti-competitive conduct; an unmanageable conflict of interest or distortion of competition linked to involvement in preparing the procurement; serious or persistent failures under previous public contracts; false or withheld information; attempts to improperly influence the contracting authority or obtain confidential information; tax offences; or lack of legal entitlement to submit a tender. The bidder must confirm that the mandatory and optional exclusion grounds do not apply.

The bidder’s net turnover must have been at least EUR 100,000 in each of the last three completed financial years. The bidder must provide extracts from the accounts for the two latest completed financial years showing net turnover, unless the information is publicly available to the contracting authority in a register. If the financial year does not coincide with the calendar year, the turnover requirement applies to the two latest completed financial years; at least six months must have passed since the end of the latest completed financial year by the tender submission date. During the 36 months before the procurement began, the bidder must have properly performed at least three sales contracts for similar corporate clothing, including at least one contract worth EUR 30,000 or more excluding VAT. Provide a list stating each contract’s performance period, the other party’s details and contact information, and, for public contracts, the procurement reference number. Evidence of proper performance must be supplied on request unless the contracting authority can obtain it from databases without significant cost. The tender must follow the prescribed pricing structure and include the completed unit-price table and manufacturers’ technical documentation demonstrating compliance with the technical specification. The bidder must confirm compliance with environmental requirements and that the offer meets the procurement documents; any claimed equivalence must be explained and supported with evidence. State the authorised contract signatory’s name, title and contact details and appoint a contract contact person; provide a power of attorney if signing authority does not arise from the articles of association. Joint bidders must appoint an authorised representative and submit their power of attorney. The bidder must confirm that it is not established or resident in Russia or Belarus and that the goods, materials and components used are not produced in or sourced from either country; certificates of origin may be requested. Conditional tenders are not permitted.
