The bidder must confirm that neither the company nor its management, supervisory body members, representatives or persons controlling it are subject to mandatory or discretionary exclusion grounds. These include final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The bidder must also have no outstanding tax or social security payment obligations, unless the obligations have been paid or a binding payment arrangement has been concluded. Other grounds include breaches of environmental, social or labour law, bankruptcy, insolvency or liquidation proceedings, agreements with creditors, comparable domestic insolvency situations, administration of assets by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated breaches of previous public contracts, submission of false or incomplete information, failure to provide requested documents, or improper acquisition of confidential information. The bidder must also confirm compliance with the national exclusion grounds concerning illegal employment of foreign nationals, international sanctions and convictions for tax offences. Where permitted, evidence of remedial measures restoring reliability may be submitted.

The bidder's registered office or residence, or that of an entity whose capacities it relies on, must be in Estonia, another EU Member State, an EEA contracting state or a country covered by the WTO Government Procurement Agreement. If the signatory's authority is not apparent from the Estonian commercial register or another source, a signed power of attorney must be submitted. Joint bidders must appoint an authorised representative and submit the relevant authorisation. The tender must include a bid guarantee of EUR 5,000 deposited into Rakvere Rural Municipality's account, or an acceptable guarantee issued by a credit institution, financial institution or insurer; the guarantee must remain valid for the entire tender validity period. The bidder must confirm compliance with the tender documents, explain any claimed equivalence and provide supporting evidence where necessary. The bidder must have an average annual turnover of at least EUR 1,000,000 during the period 30 July 2023 to 29 July 2026. If the information is not available in a public database, previous annual reports or extracts must be submitted. During the 60 months preceding the start of the procurement, the bidder must have properly completed at least one contract for an illuminated 2,500 m² light-traffic road or carriageway together with an adjacent illuminated 2,500 m² footway, or an illuminated 2,500 m² street. The bidder must provide the contract details in the ESPD and, upon request, evidence such as the client's confirmation or the works handover certificate. If relying on another entity's capacities, that entity's ESPD must also be submitted. The works must be managed by a site manager holding at least a Level 6 road engineer professional certificate or equivalent qualification. The bidder must submit evidence of the site manager's qualification and the responsible person's consent. The bidder must comply with environmental requirements, avoid negative environmental impacts, and confirm that it will not use a subcontractor subject to mandatory replacement under the Public Procurement Act. The bidder must confirm that the offered goods are not subject to international sanctions or originating from sanctioned regions. The tender must be unconditional, include the completed bill of quantities, and state and justify any trade secrets. The tender submission confirms acceptance of all conditions in the tender documents.
