Compliance requirements
The bidder must confirm that neither it nor members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the tender documents. If an exclusion ground exists, the bidder may submit evidence of self-cleaning where permitted. The ESPD also requires a response on whether the information is electronically available. The exact exclusion grounds must be checked in the tender documents or official tender details if they are not fully set out in the machine-readable notice.
Qualification criteria and exclusion grounds
The bidder must meet the financial, technical and professional qualification requirements set out in the tender documents. In particular, the bidder’s total annual turnover for the last three completed financial years before the start of the procurement must be at least EUR 1,000,000, and the average annual turnover for the same period must also be at least EUR 1,000,000 per year. The bidder must have properly performed at least one contract for construction of a lit 2,500 m2 light traffic road or carriageway with an adjacent lit 2,500 m2 sidewalk, or a lit 2,500 m2 street, completed within the 60 months before the start of the procurement. The bidder must provide the contract details and, if requested, proof of proper performance such as a client confirmation letter or handover certificate. The project manager must have at least a level 6 road engineer professional certificate or an equivalent qualification document. The bidder must also submit the consent of the responsible person, and if the bid is a joint bid, a joint bidders’ power of attorney must be attached. The bid must comply with the tender documents, and equivalence must be explained and supported by evidence where relevant. The machine-readable notice also requires confirmation of the bidder’s legal establishment in an eligible country and, where applicable, the required power of attorney and bid security documents.
