Compliance requirements

The bidder may be excluded if it or a person in its management, supervisory body or authorised representation has a relevant final conviction within the past five years, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and human trafficking. The grounds also cover unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; and significant or repeated failures under previous contracts resulting in early termination, damages, price reduction or penalties. Exclusion may also apply for false or misleading information, withholding required information or failing to provide requested supporting documents, or seeking confidential information to gain an improper advantage. Qualification criteria and exclusion grounds

The supplied goods must match the products offered in the completed technical specification, with the relevant products marked in the list. The bidder must submit that completed specification and a list of the manufacturers whose products it supplies. Each manufacturer’s quality system must be certified to ISO 9001 or an equivalent standard; a copy of the certificate must be provided. Diagnostic products, reagents, materials and accessories intended for clinical analyses must carry the required IVD/CE marking, and the bidder must confirm this in its tender. The contracting authority will check the markings on delivery. Delivery must be made to the buyer’s location as soon as possible: within 4 weeks for products in the chemistry and infectious-disease fields, and within 12 weeks for custom-made reagents, diagnostic products and analysis-kit accessories, regardless of field. At delivery, the remaining shelf life of culture media, diagnostic products, chemicals, reagents and accessories must be at least 50% of their total shelf life. The bidder must confirm that it can meet the delivery times. Equivalent products or standards may be offered where permitted, but the bidder must explain the equivalence and provide supporting evidence. The bidder must also confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. Subcontractors and suppliers used in performance must be based in Estonia, another EU Member State, an EEA contracting state or a country party to the WTO Government Procurement Agreement. In addition, Russian persons or entities, entities more than 50% owned by them, and their representatives may not be involved as subcontractors or suppliers for more than 10% of the contract value. For a joint tender, the joint bidders must appoint an authorised representative and include their authorisation. The bidder must identify by name and personal identification code any managers or authorised representatives entitled to represent, decide for or control it who are not visible in the procurement register, or confirm that there are no such persons. The bidder must identify any trade secrets in its tender and explain why they qualify; price and other information that may not legally be classified as a trade secret must not be marked as such.
