Compliance requirements
The bidder must confirm that neither it nor its management, representative or control persons have received a final conviction during the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing or the use of child labour. Exclusion grounds also cover tax or social security payment arrears, bankruptcy or insolvency proceedings, liquidation, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement procedure, serious breaches of previous public contracts, and the submission of false information or failure to provide required documents. Compliance with environmental, social and labour law obligations, rules concerning the employment of unlawfully staying foreign nationals, international sanctions and restrictions on participation in public procurement is also checked. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have completed at least two sales contracts for data analytics software during the 36 months preceding the commencement of this procurement, with a value of at least EUR 500,000 for each contract. Under each qualifying contract, the software must have been delivered to the customer, implemented and put into operation, and user training must have been provided to at least 25 people. A contract still in force at the tender submission deadline may also be accepted if the required work has been delivered and accepted in the required scope and to a value of at least EUR 500,000.
The bidder must provide a list of the contracts in the ESPD, including their value, contract period, contracting party and the customer's contact person. The procurement reference number must also be provided for contracts awarded through a public procurement procedure. If the information cannot be obtained from publicly available registers without significant effort, the bidder must provide additional explanations, data or documents within five working days of the request.
The bidder must submit a confirmation letter from a reference organisation proving that the proposed solution is used in at least one organisation in an EU Member State, an EEA country or a country covered by the relevant WTO Government Procurement Agreement, where large volumes of data, including network analysis, are processed. The solution must be integrated with that organisation's data warehouse or databases. The letter must state the organisation's name and country, describe the solution, specify the implementation or usage period, confirm operational use, confirm the integration, and provide the contact person's details.
The tender must include an audio-enabled video presentation of no more than 1.5 hours, or a functioning cloud link allowing download, demonstrating compliance with all functional requirements in Estonian or English. The compliance matrix in Annex 8 must indicate compliance for each requirement and, where necessary, include references to the video file and timestamp. The bidder must also submit the functional compliance matrix, its proposed software licence agreement and a description of the support included in the licence price, including updates, bug fixes, security patches, telephone and email support in Estonian or English, and electronic documentation. Conditional tenders are not permitted. In a joint tender, a power of attorney for the joint bidders must be included, and any trade secrets must be identified and justified; the tender price may not be classified as a trade secret.
