Compliance requirements

The bidder must confirm in the ESPD that neither it nor its management, administrative or supervisory body members, authorised representatives, procurists or other persons with representation or control powers are subject to exclusion grounds. The checks cover, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. Compliance with tax and social security payment obligations is also checked; for tax debt, the notice states that tax debt certificates are not issued for debt below EUR 100 or where payment has been deferred. The exclusion grounds also cover bankruptcy, insolvency or liquidation proceedings, assets managed by a liquidator or court, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, material breaches of previous public contracts, and the submission of false information or failure to provide required documents. The bidder must also confirm compliance with environmental, social and labour law obligations, requirements concerning the employment of unlawfully staying foreign nationals, international sanctions, and the absence of tax-related offences. Where an exclusion ground applies, remedial measures demonstrating restored reliability may be submitted in certain circumstances; the precise application must be checked in the ESPD and tender documents.

Qualification criteria and exclusion grounds

The provided ESPD does not specify separate minimum requirements for turnover, previous experience or team composition. The bidder must nevertheless submit the required ESPD and comply with the compliance requirements. The office chair must meet the technical specification, and the bidder must provide the product description and technical data using the tender submission form. The warranty must be at least 36 months, and the offered warranty period must be stated in months. The chairs must comply with EVS-EN 1335-2:2018 or an equivalent standard, with supporting evidence submitted with the tender. The required load-bearing capacity is at least 110 kg, supported by a copy of the relevant certificate. The chair fabric must comply with EVS-EN 1021-1:2014 and EVS-EN 1021-2:2014 or equivalent standards, and copies of the relevant certificates must be provided. Delivery must be made to the contracting authority’s location within no more than 30 working days after order confirmation. The tender must be unconditional, comply with the tender documents and follow the price submission structure specified on the evaluation sheet. Where applicable, equivalence must be explained and supported by evidence. In the case of a joint tender, a power of attorney for the joint tenderers must be included. The bidder must identify and justify any trade secrets; the tender price and other figures used for evaluation may not be classified as trade secrets. The bidder must review the framework agreement draft and provide the details of the contract signatory and contact person.
