Compliance requirements
A bidder may be excluded for final convictions within the last five years, or a continuing exclusion period, involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements, or suspended business activity; serious professional misconduct; agreements or conduct that distort competition; an unresolved conflict of interest or an unfair advantage from involvement in preparing the procurement; and serious or repeated breaches of previous contracts resulting in early termination, damages, price reductions or penalties. Exclusion may also result from breaches of environmental, social or labour obligations; enabling employment of a foreign national without lawful grounds or in breach of employment conditions; submitting false or misleading information, withholding required information or documents, or improperly seeking confidential information. Domestic grounds include relevant tax offences, international sanctions, and restrictions on who may participate based on place of establishment. The tax-debt threshold is stated as EUR 0, but the notice explains that an Estonian tax-debt certificate is not issued where the relevant debt is below EUR 100 or payment has been rescheduled. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must submit the completed technical description and price form, quoting a VAT-exclusive unit price in euros for every listed product. The total must equal the price entered in the procurement register and represent the total cost of the estimated quantities to be purchased during one year. The bidder must hold valid authorization from the manufacturer or rights holder to offer and sell the goods, and provide a document confirming that authorization. If the document is issued by a distributor, the manufacturer’s document authorizing that distributor must also be provided. Joint bidders must appoint an authorized representative and include their power of attorney. The bid must confirm compliance with the tender documents; conditional bids are not permitted. Where an equivalent product or solution is offered, the bidder must explain and substantiate its equivalence. Any information claimed as a trade secret must be identified and justified; prices and other specified evaluation figures may not be designated as trade secrets. The bidder must confirm that restricted Russian persons or entities will not be involved as subcontractors or suppliers for more than 10% of the contract value, that the offered goods are not subject to international sanctions and do not originate from sanctioned regions, and that subcontractors and suppliers used during contract performance are established in Estonia, another EU Member State, an EEA contracting state or a country party to the WTO Government Procurement Agreement. No specific turnover, prior-experience or staffing thresholds are stated in the provided documents.
