Compliance requirements
The bidder will be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or offences relating to the unlawful employment of foreign nationals, breaches of foreign workers’ employment conditions, child labour or human trafficking. A bidder with outstanding state tax, duty or environmental charge liabilities, or tax or social security contribution arrears under the law of its country of establishment, will also be excluded. The contracting authority may exclude a bidder for materially or repeatedly breaching an important term of a previous public contract where this led to termination, withdrawal, a price reduction, damages or a contractual penalty, or for providing false information about compliance with qualification requirements or failing to submit requested information or documents. Businesses established in Russia or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to this procurement during the 60 months preceding the start of the procurement. At least one contract must have had a value of EUR 50,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including the customer representative’s telephone number and email address) and, for public procurements, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost.
The bidder must include in its team:
- A worker with valid switching rights for the switching operations required for the works in the 0.22–20 kV electricity network, registered in Elektrilevi’s Partner Portal (EPP) before bids are opened. For low-voltage-only works (0.22–1 kV), low-voltage switching rights are sufficient; otherwise both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). Switching rights must be obtained in accordance with instruction J387.
- A person appointed as responsible for the work operation, registered in EPP before the bid submission deadline. The relevant rights must be obtained in accordance with instructions J31 and J3284.
- A person responsible for managing electrical works who holds a valid A-class competence and/or a qualification of at least level 6 under the Professions Act, has the relevant evidence as of bid submission, and is registered in EPP before the bid submission deadline.
The bid must accept all procurement-document conditions; conditional bids are not permitted. The price must be submitted using the prescribed table, with every unit-price field completed. The bidder must identify any trade secrets in its bid and explain why the information qualifies; prices and price components, as well as other figures or indicators relevant to bid evaluation, may not be designated as trade secrets. The bidder must provide the names, titles and contact details of the contract signatories and the contract-performance contact person; where signing authority is not evident from the commercial register, evidence such as a power of attorney must be supplied. Joint bidders must appoint an authorised representative and provide their power of attorney.
Standard payment periods, counted from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme instead entails a 95-calendar-day payment period. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. The notice specifies no award criterion.
