Exclusion also applies where the bidder has outstanding tax, social security or environmental charge debts under the applicable rules, or where awarding the contract would breach an international or Estonian government sanction. Foreign bidders must provide a criminal-record extract or equivalent official document covering the specified criminal grounds, and a certificate from the competent authority confirming the absence of the specified debts.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or a similar register in its country of establishment where required by that country’s law. The contracting authority checks the details of bidders registered in Estonia; a foreign bidder subject to a registration requirement must provide a valid registration certificate.
Within the 36 months before publication of the procurement, the bidder and/or its subcontractor must have properly performed at least one contract for manufacturing, constructing or selling a shelter, refuge or its components. That single contract must have been worth at least EUR 30,000 excluding VAT; the values or experience from multiple contracts may not be combined. The bidder must provide the details required by Form 1, including the contract name, client, total value excluding VAT, performance period, brief description and client contact details. The bid must be unconditional and comply with the procurement documents. The price must follow the structure specified in the pricing sheet. Joint bidders must appoint an authorised representative and submit their power of attorney. The bidder must identify and justify any claimed trade secrets; the price and evaluation-related numerical figures may not be classified as trade secrets.
The offered shelter must meet at least class V1 and the requirements of the applicable Estonian government regulation on shelters. The bid must include documentation covering all of the following: general description and structural design; floor plan showing external and internal dimensions and usable net area; exterior views or visualisations; main materials and structures; evidence such as a simulation, calculation or other technical documentation demonstrating resistance to blast-wave loads; technical documentation and conformity evidence for blast-resistant doors; ventilation design, including technical data for blast-resistant valves and fragment protection; product data and technical documentation for the crystalline waterproofing additive; requirements for transporting, loading, unloading and installing the modules; principles for dismantling and reassembly; and operating and maintenance instructions or draft versions. The submitted documents must make it possible to assess technical compliance.
The bidder must disclose known circumstances that could cause a conflict of interest or distort competition, including relevant involvement in preparing the procurement or any resulting competitive advantage. If such circumstances exist, the bidder must provide a free-form explanation identifying the person concerned, the nature of the connection and the information or other relevant circumstances. The bidder must also confirm, to the best of its knowledge, that there are no circumstances indicating a conflict of interest on the contracting authority’s side and no competitive advantage arising from its or a related person’s involvement in preparing the procurement.
