Qualification criteria and exclusion grounds

The bidder must have properly completed, during the 60 months preceding commencement of the procurement, at least one and no more than two construction contracts which, taken together, cover all of the following: excavation and earthworks relating to shaping, cleaning or reconstructing the bed or banks of a body of water, ditch or pond; creating or reconstructing a public outdoor space, park or green area, including pedestrian, cycle or hiking paths; and constructing or reconstructing hydraulic structures such as culverts, overflows, stone weirs or other structures for directing or stabilising water flow. The bidder must describe each reference, including its name and location, procurement reference where applicable, client and contact details, performance period and the works performed. At the contracting authority’s request, the bidder must provide client confirmations that the works were properly completed, identifying the contract, procurement reference where applicable, client and performance period. These confirmations need not be provided for references delivered for Tartu City Government; the authority asks bidders to include other confirmations with the tender where possible. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or established in Russia; are more than 50% directly or indirectly owned by such persons or entities; or act on their behalf or under their instructions. It must also confirm that it will not engage a subcontractor that would have to be replaced under the applicable procurement rules. If submitting a joint tender, the bidders must appoint an authorised representative and include their power of attorney. The tender must comply with the procurement documents; where an equivalent solution is offered, the bidder must explain and substantiate its equivalence. The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions. The bidder must complete all unit-price and amount lines in the attached Bill of Quantities, include the 10% client’s reserve, and account for all costs, taxes, fees, overheads and profit required to perform the contract. The tendered price is at the bidder’s risk and will not be adjusted during the works. Alternative and partial tenders are not permitted; the total works price must be entered in the procurement system. The bidder must identify any claimed trade secrets and explain why the information qualifies; the tender price and evaluation-related figures may not be designated as trade secrets. No separate award criterion is specified in the supplied documents.
