Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The tenderer must declare whether it, or any person authorised to represent, manage or control it, has a relevant final conviction within the last five years or is still subject to an exclusion period. The grounds include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include failure to pay taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, court or liquidator administration of assets, or suspended business activity; serious professional misconduct; agreements with other businesses to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement that creates an unavoidable competitive advantage; and serious or persistent failures under earlier contracts resulting in early termination, damages or comparable sanctions. Grounds also include false or misleading information, withholding required information or documents, and seeking confidential information to gain an improper advantage. National grounds include convictions for enabling the unlawful employment of a foreign national, being subject to an international sanction that would make the contract unlawful, and—at the contracting authority’s discretion—convictions for tax offences. For tax and social security debts, the notice explains that, under Estonian rules, a tax-debt certificate is not issued where the relevant debt is under EUR 100 or payment has been deferred. Where applicable, the tenderer may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The tenderer must meet both of these experience and financial requirements: - Its general annual turnover must be at least EUR 90,000 in each of the last three financial years preceding the start of the procurement. - It must have completed at least three similar contracts during the 36 months preceding the start of the procurement. Similar contracts are for information and consulting services concerning information or information and communication systems. Each contract must be worth at least EUR 90,000. The tenderer must submit a technical proposal containing at least the information required by the Technical Specification (Annex 1) and clause 6.3.3 of the Tender Requirements. It must also submit a description of the trained and qualified team and CVs stating each member’s full name, position, education and experience. Team members must meet the minimum requirements in clause 6.3.9; their specific requirements are not set out in the provided documents. The tenderer must submit the completed Application Form, a declaration on compliance with accessibility requirements or a description of relevant measures taken and planned, and a certificate confirming that it is not subject to sanctions. Participation is restricted to international or regional organisations and natural or legal persons from EU Member States, Ukraine, Western Balkan partner states, Georgia, Moldova, EEA contracting parties, and states granted mutual access to Ukraine Facility measures by the European Commission under Article 11 of Regulation (EU) 2024/792. Joint tenderers must appoint an authorised representative and include the authorisation. The tender must comply with the procurement documents; any claimed equivalence must be explained and supported with evidence. The price must follow the specified pricing structure, and conditional tenders are not permitted. The tenderer must identify and justify any business secrets, but may not classify the price or specified evaluation-related figures as confidential. It must confirm that it will not engage a subcontractor that would have to be replaced under the applicable rules.
