Compliance requirements
The bidder must declare whether it or its representatives have relevant final criminal convictions, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, and tax offences. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspended business activity or an arrangement with creditors; serious professional misconduct; competition-distorting agreements; conflicts of interest or involvement in preparing the procurement; serious or persistent failures under previous contracts, including early termination or compensation; false or misleading information, withholding information, failure to provide requested documents or seeking confidential information improperly; breaches of environmental, social or labour obligations; enabling unlawful employment of a foreign national; and a contract award that would breach international or national sanctions. Certain criminal-conviction grounds apply to convictions within the previous five years, or while an exclusion period remains in force. The bidder may provide information about remedial measures where permitted.
