Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of integrity or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences relating to the employment of people unlawfully staying in the country or violations of foreign workers’ employment conditions; or illegal child labour or human trafficking. A bidder with outstanding public tax, contribution or environmental-charge debts, or equivalent tax or social-security debts under the law of its country of establishment, will also be excluded. The contracting authority may exclude a bidder that has seriously or persistently breached an important term of a previous public contract, resulting in termination, price reduction, damages or a contractual penalty. It may also exclude a bidder that has provided false information about meeting qualification requirements or failed to submit required information or additional documents. Businesses established in Russia or Belarus are not permitted to participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 100,000 or more, excluding VAT. The bidder must submit a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address), and the procurement reference number where applicable. On request, evidence of proper performance must be provided unless the contracting authority can obtain it from databases without significant expense. The prescribed form for previous electrical works contracts must be completed; written confirmations from the other contracting parties may also be required. The bidder must have a worker authorised to carry out switching operations on the 0.22–20 kV electricity network, excluding regional and distribution substations. The worker must be registered in Elektrilevi’s partner portal before tenders are opened. For low-voltage-only works (0.22–1 kV), at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side (over 1–20 kV). The relevant training and authorisation rules apply. The bidder must also have a person appointed as responsible for the work operation, registered in the partner portal before tenders are opened, with rights obtained in accordance with the specified safety and knowledge-assessment procedures. The bidder must have a person leading the electrical works who holds a valid A-class competence and/or a qualification of at least level 6 under the applicable occupational qualifications framework. That person must hold the relevant evidence by the tender submission deadline and be registered in the partner portal before tenders are opened. The tender must include a price table using the prescribed form, with every unit-price field completed. Conditional tenders or tenders containing additional conditions are not permitted; submission confirms acceptance of the procurement documents. The bidder must provide the name, position and contact details of the contract signatory or signatories and a contract-performance contact person. If signing authority does not arise from the articles of association, a power of attorney must be included. The bidder must identify and justify any information claimed as a trade secret; the tender price and evaluation-related figures may not be designated as trade secrets. The contracting authority’s standard invoice payment period is 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. Materials, equipment, goods and components installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. No award criterion is specified in the provided document text.
