Compliance requirements
A bidder may be excluded if it has outstanding public tax, duty or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. Deferred debts are accepted. The contracting authority will check the tax status of bidders established in Estonia directly; bidders established elsewhere may be asked to provide evidence that they have no such debts.
Bidders from third countries are excluded. For this procurement, third countries are countries outside the EU and EEA, countries that are not parties to the WTO Government Procurement Agreement, and countries that do not have an EU free trade agreement containing public procurement provisions. The bidder must state the country in which it is registered.
Qualification criteria and exclusion grounds
The bidder must have annual sales revenue of at least EUR 600,000 in each of the last three completed financial years that ended at least six months before the procurement procedure began. The tender documents request revenue figures for 2023, 2024 and 2025. A bidder established outside Estonia may be asked to provide signed annual accounts or equivalent documents as evidence.
At least one specialist involved in constructing the paved area must hold a valid Level 7 diploma-level road engineer qualification or an equivalent qualification. The bidder must provide the specialist’s name and, if the qualification cannot be checked in a public database, a copy of the certificate.
During the 60 months preceding the start of the procurement, the bidder must have acted as main contractor to build at least two paved areas, each with a net area of at least 10,000 m². For each reference, provide the client’s name and contact details, a description of the contract, the bidder’s role, and the month and year when the works were accepted.
The bid must comply with the tender documents and be unconditional. The price must follow the required structure and cover all works described in the preliminary design and bill of quantities. Form 3, the bill of quantities, must be completed and submitted. If an equivalent solution is offered, its equivalence must be explained and supported by evidence. For a joint bid, a power of attorney for the joint bidders must be provided. The bidder must identify and justify any information claimed as a trade secret; the bid price and indicators relating to the award criteria may not be designated as trade secrets.
The bidder must accept the contractual penalties set out in the tender documents and provide a warranty of at least 12 months from acceptance of the works. The contract will be signed no later than three months after submission of the bid, and all works must be completed and handed over to the contracting authority within 12 months of contract signature. The scope also includes applying for the occupancy permit and any other permits, approvals and documents required for the works and the building’s use. The contractor is responsible for preparing and submitting the documents and participating in the proceedings until the permits are issued.
