Compliance requirements
The bidder will be excluded if it, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of duty of honesty or corruption, fraud, terrorist offences or related conduct, money laundering or terrorist financing; offences involving the unlawful employment of foreign nationals or breaches of their employment conditions, including underpayment; or unlawful use of child labour or human trafficking. A bidder with outstanding national tax, statutory payment or environmental charge liabilities, or unpaid taxes or social security contributions under the law of its country of establishment, will also be excluded.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached a material term of an earlier public contract, leading to termination, cancellation, a price reduction, compensation or a penalty, or that has provided false information about meeting qualification requirements or failed to provide requested information or documents. Businesses established in Russia or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 60,000 or more, excluding VAT. The bidder must submit a list showing each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant effort.
The bidder must include in its team:
- A person with valid switching authorisations for the relevant work on the 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the tender deadline. For work limited to 0.22–1 kV, at least low-voltage switching authorisations are required; otherwise, both low- and medium-voltage authorisations are required, including where low-voltage work requires switching on the medium-voltage side.
- A person appointed as responsible for work operations, registered in the partner portal before the tender deadline.
- A person leading electrical works who holds a valid A-category competency or, under the Vocational Qualifications Act, a qualification at least at level 6, has the relevant evidence as of submission, and is registered in the partner portal before the deadline.
The tender must include a completed price table using the form in the procurement documents; every unit-price field must be filled in. The bidder must also follow the completion instructions in management-system document V178. The bidder must provide the name, position and contact details of the contract signatory or signatories and of the contact person for contract-performance matters. If the signatory’s authority is not based on the articles of association, a power of attorney must be included. Joint bidders must appoint an authorised representative and provide their power of attorney.
The bidder must confirm that the offer complies with the procurement documents and must not submit a conditional offer or one containing additional conditions. It must identify and justify any trade secrets; the total price, component prices and specified offer-evaluation figures may not be designated as trade secrets. Materials, equipment and goods, including components, installed or used in the works must not originate from or be produced in Russia or Belarus; the contracting authority may request certificates of origin.
Standard payment periods from receipt of the invoice are 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme instead entails a 95-calendar-day payment period.
