Compliance requirements
The tenderer must declare whether it or its representatives have relevant final convictions, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Declarations also cover breaches of tax and social security payment obligations; environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation, creditor arrangements, administrator-managed assets or suspended business; serious professional misconduct; agreements intended to distort competition; unresolved conflicts of interest; involvement in preparing the procurement that creates an unremediable competitive advantage; serious or repeated breaches of previous contracts; and false or misleading information, omitted information or failure to provide requested documents, as well as improper attempts to obtain confidential information.
National grounds include enabling a foreign national to work without a legal basis, international sanctions, certain local tax debts, convictions for tax offences and any applicable restriction on participation based on the tenderer’s place of establishment. Where relevant, the tenderer may describe measures taken to restore its reliability. First-tier subcontractors are checked and must submit an ESPD; the notice does not provide for checks of second- and later-tier subcontractors. For Estonian tax debts, a certificate is not issued where the debt is below EUR 100 or payment has been rescheduled; foreign tenderers are assessed under the rules of their country of establishment.
Qualification criteria and exclusion grounds
The tenderer’s total general turnover for up to the last three officially available financial years must be at least EUR 100,000. Submit a free-form statement showing turnover for those years, supported by tax returns, annual reports or similar documents.
Submit confirmation and supporting documents showing that the training provider is an experienced professional, is an official partner for the relevant courses and has the legal rights to sell the products offered. Also provide a description of the actual training package demonstrating compliance with clauses 7.1–7.3 of the Technical Specification. It must cover the courses, delivery format and learning materials; learning approach and practical exercises; participants, enrolment and access; certification exam vouchers; and course syllabi. Existing provider materials may be used if they clearly identify the courses, delivery format, resources and options included. A general compliance statement alone is insufficient.
Submit the required turnover information and documents under clause 3.1 of the procurement documents, and the confirmation required by clause 4.3.10. Where the tender involves joint tenderers, subcontracting or reliance on another entity’s resources, provide a free-form description of the expected size and nature of each party’s share of the contract and the relevant joint tenderer’s ESPD. Joint tenderers must appoint an authorised representative and provide a power of attorney.
The offer must comply with the procurement documents and must not be conditional. Submit pricing in the prescribed structure. If claiming equivalence, explain it and provide supporting evidence. Identify any claimed trade secrets and justify the designation; prices and specified evaluation-related figures may not be marked as trade secrets. Confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The notice documents do not specify an award-scoring formula.
