Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The ESPD asks the bidder to declare whether, within the past five years or while an exclusion period remains in force, the bidder or a person in its management or control has been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. It also covers breaches of tax and social security payment obligations, enabling the employment of a foreign national without legal grounds or breaches of employment conditions, and whether awarding the contract would violate an international or Estonian government sanction. The stated threshold for tax and social security arrears is EUR 0; the notice also explains that a tax-debt certificate is not issued for arrears below EUR 100 or where payment has been rescheduled. The bidder must provide the requested declarations and, where relevant, details of the offence or arrears and any corrective measures. Evidence of restored reliability may be submitted only where the procurement exceeds the international threshold or the procurement documents allow it.

Qualification criteria and exclusion grounds

The ESPD contains no specific financial-capacity, experience, personnel or other qualification thresholds. The bidder must submit the completed price table as an Excel file, using the buyer’s work categories and excluding VAT. The total price must be stated in euros to two decimal places; the prescribed work descriptions, units, quantities and other data must not be altered. The bid must confirm acceptance of the procurement-document conditions; conditional bids are not allowed. Joint bidders must appoint an authorised representative and provide a power of attorney. Any claimed trade secrets must be identified and justified, but prices and other evaluation-related figures may not be designated as trade secrets. Where an equivalent product or solution is offered, the bidder must explain the equivalence and provide supporting evidence. The bidder must also make the required declarations concerning replacement-requiring subcontractors, sanctioned subcontractors and suppliers (including those accounting for more than 10% of the contract value), and goods subject to international sanctions or originating in sanctioned regions. The bid price must follow the structure specified in the procurement documents.
