Compliance requirements
The bidder must not be subject to the exclusion grounds set out in § 95(1)(1–5) and § 95(4)(12) of the Estonian Public Procurement Act and must confirm their absence. If other persons authorised to represent, make decisions for or control the bidder are not visible in the commercial register, the bidder must provide each person’s name and personal identification code, or confirm that there are no such persons.
Qualification criteria and exclusion grounds
The bidder’s net turnover from all business activities must have been at least EUR 200,000 in each of the three most recently completed financial years. The bidder must provide the turnover figures for those years; if requested and the information is not available from a public register, it must submit the relevant annual accounts or extracts. Where turnover requirements differ between lots, the figures are not added together; the highest required turnover takes priority. A bidder relying on another entity’s resources must submit that entity’s consent in the form of Annex 5, including the amount of turnover made available, its commitment to provide financial resources if needed, and its joint responsibility for proper contract performance. If joint bidders rely on one another’s resources, the tender must describe the size and nature of each party’s share of the contract. Foreign entities participating as bidders, joint bidders or subcontractors must provide documents confirming the required turnover. The bidder must have at least one sales outlet in Tallinn where the buyer can purchase goods and must provide its exact location.
The tender must comply with the procurement documents and may not be conditional. Joint bidders must appoint an authorised representative and submit the power of attorney in the form of Annex 6. The bidder must identify any information claimed as a trade secret and explain why; the tender price and other specified evaluation-related figures may not be treated as trade secrets. The bidder must confirm compliance with the requirements and, where offering an equivalent product or solution, explain the equivalence and provide supporting evidence. The bidder must also confirm that restricted Russian-linked subcontractors or suppliers will not perform more than 10% of the contract value, and that the goods offered are not subject to international sanctions and do not originate from sanctioned regions. The price must be submitted in the prescribed structure, including the completed Annex 3 sample shopping basket cost form, with its total transferred to the designated price field.
