Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if the bidder or a person authorised to represent, manage, supervise or control it has been convicted of participation in a criminal organisation, breach of the duty of integrity or a corruption offence, fraud, a terrorist offence or related activity, money laundering or terrorist financing; of enabling the unlawful employment of a foreign national or breaches of the conditions for employing a foreign national in Estonia, including paying below the statutory minimum; or of unlawful use of child labour or human trafficking. A bidder with outstanding state tax, payment or environmental-charge debt, or tax or social-security contribution debt under the law of its country of establishment, will also be excluded. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an essential term of a previous public contract, resulting in termination, cancellation, a price reduction, compensation or a contractual penalty, or that has provided false information about meeting qualification requirements or failed to submit required information or additional documents. Businesses established in Russia or Belarus are not permitted to participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must be worth €40,000 or more, excluding VAT. The bidder must submit a list stating each contract’s performance period, the other contracting party’s details (including the client representative’s telephone number and email address), and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost. The bidder must have an employee with valid switching rights for the switching operations required by the works in the 0.22–20 kV electricity network, excluding regional and distribution substations. The employee must be registered in Elektrilevi’s partner portal before bids are opened. For works involving only low-voltage installations (0.22–1 kV), low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (above 1 kV and up to 20 kV). The training and authorisation process must follow document J387. The bidder must have a person appointed as responsible for the work operation, registered in the partner portal before bids are opened. The relevant authorisation process must follow documents J31 and J3284. The bidder must also have a person leading the electrical works who, when bids are submitted, holds a valid A-class competence certificate and/or a qualification of at least level 6 under the Professions Act, and who is registered in the partner portal before bids are opened. The bid must include a completed price table using the form in the procurement documents, with every unit-price field filled in, and must take account of the completion instructions for control system document V178. Conditional bids and bids containing additional conditions are not permitted; submitting a bid confirms acceptance of the procurement-document conditions. The bidder must provide the name, job title and contact details of the contract signatory or signatories and a contract-performance contact person. If the signatory’s authority does not arise from the articles of association, a power of attorney must be included. The standard payment period from receipt of the invoice is 14 calendar days for contracts up to €59,999, 35 calendar days for contracts from €60,000 to €249,999, and 45 calendar days for contracts of €250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. Materials, equipment and goods, including components, installed or used during the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. The bidder must identify and justify any trade secrets in its bid, but may not classify the bid price or price components as trade secrets.
