Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if the bidder or a person authorised to represent, manage, control or supervise it has been convicted of offences involving participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism or related offences, money laundering or terrorist financing, or unlawful employment of foreign nationals, including breaches of employment conditions or underpayment. Convictions relating to unlawful child labour or human trafficking also result in exclusion. Exclusion also applies where the bidder has outstanding tax, social security contribution or environmental levy debts, or where awarding the contract would breach an international or Estonian government sanction. The contracting authority may also exclude a bidder for serious or persistent failure to perform a previous public contract where this led to termination, withdrawal, a price reduction, damages or a contractual penalty, or for providing false information or failing to submit requested qualification information or supporting documents. Enterprises established in Russia or Belarus may not participate in the procurement.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 300,000 in each of the last three completed financial years. The bidder must provide extracts from the annual accounts showing turnover, unless the information is publicly available to the contracting authority from a register. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years; at least six months must have passed since the end of the last completed financial year by the bid submission date. During the 60 months preceding the start of the procurement, the bidder must have duly performed at least three contracts for electrical construction works similar to the contract being procured. At least one of these contracts must have had a value of EUR 250,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details and contact information (including telephone number and email address), and the procurement reference number where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost. The bidder must have a person responsible for managing electrical works who holds valid A-class competence and/or a qualification of at least level 6 under the applicable professional qualifications framework. The person must hold the relevant evidence by the bid submission deadline and be registered in Elektrilevi’s Partner Portal before bids are opened. The bidder must have a worker with switching authorisations for the work-related operations on the 0.22–20 kV electricity network, excluding regional and distribution substations, and that worker must be registered in the Partner Portal before bids are opened. For works limited to low voltage (0.22–1 kV), low-voltage switching authorisations are required. In other cases, both low- and medium-voltage authorisations are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). Applications for switching authorisations must follow training procedure J387. The bidder must also have a person appointed as responsible for the work operation, registered in the Partner Portal before bids are opened; the relevant authorisations must follow documents J31 and J3284. The bid must be unconditional, accept the tender-document requirements and include the completed pricing table in the required format, with every unit-price field filled in. The bidder must identify the authorised contract signatory or signatories and provide their names, titles and contact details, as well as the contract-performance contact person’s details. A power of attorney must be included if signing authority does not arise from the articles of association. For a joint bid, the participants must appoint an authorised representative and include their power of attorney. Standard invoice payment periods, measured from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The bidder must state which option applies. The bidder must identify any information claimed as a trade secret and explain the grounds; the bid price and other specified evaluation-related figures may not be classified as trade secrets. No award criterion or scoring method is specified in the provided documents.
