Compliance requirements

The bidder will be excluded if the bidder, or a person in its management, supervisory or administrative body, a procurist or another person authorised to represent or control the bidder or make decisions on its behalf, has been convicted of participation in a criminal organisation, breach of the duty of integrity or a corruption offence, fraud, terrorism-related offences, money laundering or terrorist financing; of enabling the unlawful employment of a foreign national or a breach of the conditions for employing a foreign national in Estonia, including paying below the statutory wage rate; or of the unlawful use of child labour or human trafficking. A bidder with outstanding national tax, duty or environmental charges, or tax or social security contribution debts under the law of its country of establishment, will also be excluded. The contracting authority may exclude a bidder that has seriously or persistently breached an essential term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty; or that has provided false information about meeting qualification requirements or failed to submit required information or additional documents. Participation is prohibited for undertakings established or resident in Russia or Belarus.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have been worth at least EUR 80,000 excluding VAT. Provide a list stating each contract’s performance period, the other contracting party’s details (including the client representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from public or private databases without significant expense. The team must include: - A worker with valid switching authorisations for the switching operations required for the works in the 0.22–20 kV electricity network, excluding regional and distribution substations. For works limited to 0.22–1 kV low-voltage installations, low-voltage switching authorisation is sufficient; otherwise, both low- and medium-voltage switching authorisations are required, including where low-voltage works require switching on the medium-voltage side. The worker must be registered in Elektrilevi’s partner portal before the bids are opened. The applicable training procedure is set out in document J387. - A person responsible for the work operation, registered in Elektrilevi’s partner portal before the bid submission deadline. The applicable requirements are set out in documents J31 and J3284. - A person leading the electrical works with a valid A-class competence or, under the Professions Act, a qualification of at least level 6. This person must hold the relevant evidence as of bid submission and be registered in Elektrilevi’s partner portal before the submission deadline. The bid must include a price table using the form in the procurement documents, with every unit-price field completed. Bidders must also follow the completion instructions for the control-system document V178. The bid must accept all procurement-document conditions; conditional bids or bids containing additional conditions are not permitted. Provide the name, title and contact details of the contract signatory or signatories and of the contact person for contract matters. If the signatory’s authority does not arise from the company’s articles of association, include a power of attorney. Identify any claimed trade secrets and explain the designation; bid prices and other specified evaluation-related figures may not be designated as trade secrets. Standard payment periods, measured from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The bidder must confirm that the bidder’s registered office is not in Russia or Belarus. Materials, equipment and goods, including components, installed or used in carrying out the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.
