Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if the bidder or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation; breach of integrity or corruption; fraud; terrorist offences or related participation; money laundering or terrorist financing; unlawful employment of a foreign national or enabling a foreign national to work in Estonia in breach of applicable conditions, including paying below the statutory rate; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has tax, social security contribution or environmental charge arrears, or where awarding the contract would breach an international or Estonian government sanction. The contracting authority may also exclude a bidder for a substantial or repeated breach of a previous public contract that resulted in termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information about compliance with selection requirements or failing to submit required information or documents. Businesses established or resident in the Russian Federation or Belarus may not participate in the procurement.

Qualification criteria and exclusion grounds

The bidder’s net turnover must be at least EUR 300,000 in each of the last three completed financial years. The bidder must provide extracts from the relevant annual reports showing turnover, unless the information is publicly available to the contracting authority from a register. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years; at least six months must have passed since the end of the latest completed financial year by the bid submission date. Within the 60 months preceding the start of the procurement, the bidder must have duly performed at least three contracts for electrical construction works similar to the contract subject; at least one contract must have a value of EUR 100,000 or more, excluding VAT. A list must be provided stating the performance period, the other contracting parties’ details and the client representative’s contact details, including telephone number and email address, as well as procurement reference numbers where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost. The bidder must have an electrical works supervisor holding valid A-level competence and/or a qualification of at least level 6 under the Professions Act. The person must hold the relevant proof by the bid submission date and be registered in Elektrilevi’s partner portal before bids are opened. The bidder must have a worker authorised to carry out switching operations related to the works in the 0.22–20 kV electricity network, excluding regional and distribution substations, and registered in the partner portal before bids are opened. For works limited to low voltage (0.22–1 kV), at least low-voltage switching rights are required. In all other cases, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side (over 1–20 kV). The applicable training procedure must be followed. The bidder must also have a person designated as responsible for the work operation, registered in the partner portal before bids are opened, with the relevant rights obtained in accordance with the applicable safety and knowledge-assessment procedures. The bid must include a price table using the form in the procurement documents, with every unit-price field completed. The bidder must accept all procurement-document conditions; conditional bids or bids with additional conditions are not allowed. The bidder must identify and justify any trade secrets, but may not classify the bid price or other specified evaluation-related figures as trade secrets. The bidder must provide the name, position and contact details of the person or persons authorised to sign the contract, together with those of the contract-performance contact person. If signing authority does not arise from the articles of association, a power of attorney must be included. In a joint bid, the participants must appoint an authorised representative and provide the relevant power of attorney. Payment terms, calculated from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999; 35 days for contracts from EUR 60,000 to EUR 249,999; and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme entails a 95-calendar-day payment term. The award criteria are not specified in the provided document text.
