Compliance requirements
Exclusion grounds include final convictions within the past five years, or a continuing exclusion period imposed by a judgment, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. These grounds also apply to members of the bidder’s administrative, management or supervisory bodies and persons authorised to represent, make decisions for or control the bidder. Where legally available, the bidder may provide evidence of measures taken to restore its reliability.
A bidder may be excluded for unpaid taxes or social security contributions in its country of establishment or in the buyer’s country. The notice gives a threshold of EUR 0 and notes that, under Estonian rules, a tax-debt certificate is not issued for a debt below EUR 100 (excluding interest not determined by an administrative act) or where payment has been deferred. Exclusion grounds also include enabling the unlawful employment of a foreign national and entering into a contract that would violate an international or Estonian government sanction.
