Compliance requirements
The bidder may be excluded if it, or a member of its administrative, management or supervisory body or a person authorised to represent, make decisions for or control it, has a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or another form of human trafficking, or remains subject to an exclusion period imposed by a judgment. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
A bidder may also be excluded for failing to meet tax or social security payment obligations in Estonia or its country of establishment. The notice sets the threshold at EUR 0; however, it notes that tax debt of less than EUR 100, excluding interest not determined by an administrative act, is not treated as tax debt for this purpose, and that payment may be deferred. The bidder must also confirm that entering into the contract would not breach an international or Estonian government sanction.
Qualification criteria and exclusion grounds
The bidder must hold authorisation to provide the insurance service covered by the framework agreement under section 15(1) of the Insurance Activities Act. A foreign bidder must be entitled to operate in Estonia under the applicable provisions of that Act. The contracting authority will check the relevant information published by the Estonian Financial Supervision and Resolution Authority and may request evidence if the information is not freely available in the register.
The bidder must provide a description of the proposed service in accordance with point 5 of Annex 1 and confirm that it will provide the service on the terms set out in the procurement documents. It must state the annual compensation limits in euros for the services in each of the three insurance packages. A joint bid must include written authorisation for one bidder to represent the other. The bidder must declare whether the bid contains trade secrets and, if so, identify the protected information and explain why it qualifies as a trade secret. The bid must remain valid for three months from the submission deadline.
