Compliance requirements
The bidder may be excluded if, within the previous five years or while an exclusion period remains in force, the bidder or a person authorised to represent, manage or control it has been finally convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Exclusion may also apply for unpaid taxes or social security contributions. The stated threshold is EUR 0; the notice explains that, under Estonian tax rules, a tax-debt certificate is not issued where the debt is below EUR 100 (excluding interest not established by an administrative act) or payment has been deferred. The bidder must also confirm that entering into the contract would not violate an international or Estonian government sanction. Where an exclusion ground applies, the bidder may provide evidence of measures taken to restore its reliability if the procurement is above the international threshold or the tender documents allow this.
Qualification criteria and exclusion grounds
The bidder must have properly performed fish-feed sales or supply contracts during the 36 months before the procurement began, with a total value of at least EUR 50,000 excluding VAT. At least one contract is required. For each relevant contract, provide its subject, customer, performance period and the value of the part properly performed by the bidder, excluding VAT.
The bidder must be the official sales representative in Estonia for the manufacturer of the offered fish feed and must submit a copy of a valid document issued by that manufacturer confirming the sales authorisation.
The bidder must confirm compliance with the tender documents and may not submit a conditional tender. The tender price must follow the structure specified in the pricing schedule. If relying on equivalent products or evidence, explain the equivalence and provide supporting evidence where required. The offered goods must not be subject to international sanctions or originate from sanctioned regions.
The bidder must confirm that subcontractors and suppliers involved in performing the contract do not account for more than 10% of the contract value if they are Russian nationals, residents or entities established in Russia; are more than 50% directly or indirectly owned by such persons or entities; or act as their representatives or on their instructions. Joint bidders must appoint an authorised representative and submit the relevant power of attorney. Any information identified as a trade secret must be described and justified; the tender price, component prices and specified evaluation-related figures may not be designated as trade secrets.
