Compliance requirements
A bidder must be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful use of child labour or human trafficking; if it has been convicted of enabling unlawful employment of a foreign national or breaching the conditions for their employment in Estonia, including paying below the statutory wage rate; if it has tax, social security contribution or environmental charge arrears; or if awarding the contract would breach an international or Estonian government sanction.
The contracting authority may also exclude a bidder for serious or repeated breaches of a previous public contract that led to termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information or failing to provide requested information or documents concerning exclusion grounds or qualification. The bidder must submit the declarations on the absence of exclusion grounds using Appendix 5. For a joint bid, each joint bidder must provide the relevant declarations. The contracting authority checks first-tier subcontractors for the applicable statutory exclusion grounds during the procedure and, where relevant, during contract performance.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU or EEA member state, or a state that is a party to the WTO Government Procurement Agreement, where registration is required by the law of the bidder’s country of establishment. A current registration certificate must be provided if requested; bidders registered in Estonia do not need to submit one.
The bidder’s net turnover, excluding VAT, must have been at least EUR 1,600,000 in each of the three financial years 2023, 2024 and 2025. If the bidder’s financial year does not run from 1 January to 31 December, the corresponding financial-year periods apply. Turnover details must be provided using Appendix 5; supporting accounts or other evidence must be provided if requested, unless the information is publicly available to the contracting authority.
During the 60 months before the procurement commenced, the bidder must have completed at least one similar construction contract, with the works accepted and no material breaches. The bidder must have acted as the main contractor. The works must have concerned a building or part of a building with at least 500 m² of enclosed net floor area and involved construction, extension or full reconstruction, including structural works; technical systems (heating and ventilation, cooling and heat supply, water supply and sewerage); electrical installations (power, low-voltage and automation); fire safety; and energy efficiency. Contract details must be given in Appendix 5; a client’s confirmation must be provided if requested.
If relying on another entity’s resources to meet the financial or technical and professional capacity requirements, the bidder must identify that entity in Appendix 5 and provide its declarations using Appendix 5.1. For a joint bid, all joint bidders must submit the required exclusion-ground declarations. They must appoint an authorised representative and accept joint and several liability using Appendix 4, signed by all joint bidders.
The bidder must submit the participation declaration in Appendix 2 and accept all tender-document requirements without conditions; conditional bids are not permitted. The bid price must be stated in euros in the required structure and in the price schedule in Appendix 7, with all required fields completed and no additional notes or alterations to the schedule. The bidder must identify any trade secrets and explain why the information qualifies as such, or state that the bid contains none. Any claimed equivalence must be explained and supported by evidence.
For furniture, all wood used must come from legal sources; evidence of origin, such as an FSC certificate or FLEGT or CITES licence, must be provided upon delivery. The bidder must declare REACH candidate-list substances present above 0.1% by mass in the product or any component or material, and provide evidence upon delivery of their presence or absence. Furniture must be dismantlable with hand tools and repairable by an untrained person; disassembly and repair instructions must be supplied. The furniture must have a warranty of at least two years from delivery, covering repairs and a replacement product during warranty repairs without extra charge. Spare parts or functionally equivalent components must be available for at least two years after delivery. No award-scoring criteria are specified in the provided documents.
