Compliance requirements
Exclusion may apply where the bidder, or a person in its management, supervisory or representative bodies, has a relevant conviction within the previous five years or is still subject to an exclusion period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; or involvement in preparing the procurement that creates an advantage which cannot otherwise be avoided.
Exclusion may also apply for significant or repeated breaches of earlier contracts resulting in early termination, damages, price reductions or penalties; breaches of environmental, social or labour obligations; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information improperly. National grounds include enabling the illegal employment of a foreign national, entering into a contract in breach of international or national sanctions, and, as a discretionary ground, relevant tax offences. For tax arrears, the notice sets a threshold of EUR 0; the stated national rule provides that a tax-debt certificate is not issued for arrears below EUR 100 or where payment has been rescheduled. Where legally available, the bidder may provide evidence of remedial measures demonstrating restored reliability.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 100,000 in each of the last two financial years completed before the procurement began. The bidder must also have properly completed at least two contracts during the 36 months preceding the procurement for scientific institutions. These contracts must concern remote monitoring, remote management, monitoring and data-collection systems or equipment, or similar research and development activities, and must have a value of at least EUR 5,000. The bidder must provide the contract details in the European Single Procurement Document, including dates and the other contracting parties.
The proposed equipment must meet the technical description in Annex 1. The bid must include a free-form description or diagram of the proposed solution, a list of components (logger, enclosure, power supply and connections), and technical datasheets for all main components, with the devices shown on the diagram and references to their datasheets. Equivalent solutions are permitted where equivalence is explained and supported with evidence.
Joint bidders must appoint an authorised representative and include the authorisation in the bid. The bidder must identify any trade secrets in the bid and explain their classification; price and other specified evaluation-related figures may not be treated as trade secrets. Conditional bids are not permitted, and submission confirms acceptance of the procurement-document requirements. The bidder must also confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. For contracts within the international threshold, the bidder must confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers covered by the applicable EU restrictions on Russian persons and entities. No award criteria are stated in the provided documents.
