Compliance requirements
The bidder may be excluded for relevant final convictions of the bidder or its management, supervisory or representative persons within the applicable period, including convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. The bidder must also meet its tax and social security payment obligations. The notice sets a zero-euro threshold; under Estonian rules, a tax debt below EUR 100 or a debt whose payment has been deferred is treated as described in the tender information.
Other grounds include breaches of environmental, social or labour law; bankruptcy, liquidation, insolvency proceedings, an equivalent situation, creditor arrangements, administration of assets by a liquidator or court, or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unremovable competitive advantage; significant or persistent failures under previous contracts resulting in early termination, damages, price reductions or penalties; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procedure. National grounds also cover enabling the unlawful employment of a foreign national, international sanctions and convictions for tax offences. Where applicable, first-tier subcontractors are also subject to the stated checks. If a ground applies, the bidder may provide evidence of remedial measures where permitted by law or the tender documents.
Qualification criteria and exclusion grounds
The bidder must have a suitably qualified person responsible for the works: either a responsible specialist under the applicable land improvement legislation, or at least one road engineer with professional qualification level 6 and a road construction specialisation, or an equivalent or higher qualification. The bidder must provide the responsible person's details and, where necessary, evidence of equivalent competence or authorisation to perform the relevant work in the person's home country.
During the 60 months preceding the start of the procurement, the bidder must have completed, as main contractor or as a subcontractor responsible for carrying out or managing all the works, at least one qualifying road construction or reconstruction project, with a combined scope of at least 9 km or 45,000 m². Eligible works include qualifying land improvement roads, public roads or forest roads. The bidder must list the relevant contracts in the procurement passport. At the contracting authority's request, it must provide the client's confirmation that the works were properly performed; where the bidder was a subcontractor, confirmation from the main contractor must also attest to the bidder's role. If relying on another entity's capacity, the bidder must provide that entity's procurement passport.
The bid must include the completed price offer form. A joint bid must include an authorisation appointing a representative. A bid guarantee of EUR 2,500 is required, provided as a guarantee from a credit or financing institution or insurer, or as a deposited amount; it must remain valid at least until the end of the bid validity period. Conditional bids are not permitted. The bidder must confirm compliance with the tender documents and explain and substantiate any claimed equivalence. The bidder must also confirm compliance with the contracting authority's environmental requirements for forestry work, the applicable worker-rights and complaints procedures, and the stated restrictions on subcontractors and suppliers. Information designated as a trade secret must be identified and its confidential status justified; the bid price and evaluated numerical indicators may not be designated as trade secrets. No award criteria or scoring method is specified in the supplied documents.
