Compliance requirements
The bidder must confirm that none of the exclusion grounds specified in § 95(1), points 1–5, and § 95(4), point 12, of the Estonian Public Procurement Act apply. For the exclusion check, provide the name and personal identification code of any person authorised to represent, make decisions for or control the bidder (including a joint bidder, relied-upon entity or foreign-company branch) who is not visible to the contracting authority in the commercial register, or confirm that there are no such persons. The prescribed consents from relied-upon entities and subcontractors also include confirmation that no exclusion grounds under the procurement documents apply to them.
Qualification criteria and exclusion grounds
The bidder must provide the following separate personnel for contract performance; roles may not overlap: a construction manager with at least a valid Level 7 HVAC engineering qualification and the additional competency for managing construction of cooling systems, or equivalent; at least four refrigeration mechanics, each with at least a valid Level 4 qualification or equivalent; a design manager with at least a valid Level 7 HVAC engineering qualification and the additional competency for designing indoor climate systems, or equivalent; an electrical works specialist with at least valid B-level electrical competency or equivalent; and a project manager. The bidder must provide the personnel details and qualification evidence as required. For qualifications obtained outside Estonia, copies of the relevant evidence must be submitted. If relying on another entity’s resources, the bidder must provide that entity’s consent in the prescribed form, show that it will directly perform the relevant part of the contract, and identify any relied-upon subcontractor. Joint bidders relying on one another’s resources must state each party’s share and the nature of its work.
Within the 60 months preceding publication of the contract notice, the bidder must have completed at least two contracts involving the supply, installation and commissioning of building cooling equipment. The portion completed during that period must be worth at least EUR 100,000 excluding VAT for each contract. Details must be provided using Annex 4, including the contract subject, period, value and client contact details.
Within the 60 months preceding publication of the contract notice, the bidder must also have properly completed at least two contracts involving building automation construction and/or reconstruction works. The relevant works must have been completed, handed over and accepted by the client within the reference period, except that the warranty period may still be running. Contract details must be submitted using Annex 4.1, together with two client confirmations of proper performance; handover and acceptance certificates alone are not accepted as client confirmations.
The project manager must have completed Siemens Desigo CC and Siemens Desigo XWorks training and, during the seven years preceding the contract notice publication deadline, have managed at least two building automation construction, reconstruction and/or design projects as the contractor’s project manager. The project manager must be different from all other listed responsible personnel. Submit training certificates and the experience details using Annex 6. If the project manager is a subcontractor, identify the subcontractor and provide its signed commitment to participate in contract performance using Annex 8.
The bidder or its subcontractor must hold a valid permit, where required by the law of its country of establishment, for handling products, equipment or systems containing fluorinated greenhouse gases or their alternatives. For entities established outside Estonia, provide evidence from the competent authority where such a permit is legally required. If relying on a subcontractor’s permit, that subcontractor must itself perform the relevant contract work.
The offer must be unconditional and comply with the procurement documents. Submit the price in the specified structure and provide the completed price form in Annex 3, transferring its total to the designated price field. The work must be performed in an environmentally responsible manner, including sorting and recycling waste and using environmentally friendly equipment where possible. Where an equivalent product, method or evidence is offered, explain and substantiate the equivalence. Confirm that offered goods are not subject to international sanctions and do not originate from sanctioned regions. Joint bidders must appoint an authorised representative and submit the power of attorney in Annex 7. The bidder must identify and justify any information claimed as a trade secret; prices and evaluation-related figures may not be designated as trade secrets. No award-scoring method is specified in the provided documents.
