Compliance requirements
The bidder must confirm that no mandatory exclusion grounds apply. These include specified convictions involving participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; unlawful employment of foreign nationals or breaches of their employment conditions; child labour or human trafficking; outstanding tax, social security or environmental charge debts; and applicable international sanctions affecting the bidder or relevant persons representing or controlling it.
The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; insolvency, liquidation or comparable circumstances; serious professional misconduct; anti-competitive agreements or coordinated conduct; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unremediable competitive advantage; serious or persistent failure to perform an earlier public contract; false or omitted qualification information or required supporting documents; attempts to improperly influence the contracting authority or obtain confidential information; certain tax-related convictions; or lack of the legal right to submit a bid. The bidder must confirm that these grounds do not apply. Companies established in Russia or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 200,000 in each of the last three completed financial years. The bidder must provide extracts from the annual accounts showing turnover for those years, unless the information is publicly available to the contracting authority from a register for a company registered in Estonia. At least six months must have elapsed since the end of the bidder’s most recently completed financial year by the bid submission date.
During the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts involving electrical construction works similar to this contract. At least one must have had a value of EUR 80,000 or more, excluding VAT. Provide a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address), and the procurement reference number where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant expense.
The bidder’s team must include a person responsible for managing electrical works with valid A-level competency and/or a qualification of at least level 6 under the Professions Act. The person must hold the relevant evidence and be registered in Elektrilevi’s partner portal before the bid submission deadline. The team must also include a worker with switching authorisations for the relevant works in the 0.22–20 kV network, registered in the partner portal before bids are opened. For work limited to 0.22–1 kV, at least low-voltage switching authorisation is required; otherwise both low- and medium-voltage switching authorisations are required, including where low-voltage work requires switching on the medium-voltage side. A person responsible for the work operation must also be appointed and registered in the partner portal before the bid submission deadline.
The bid must comply with the tender documents without additional or conditional terms. Submit the price using the required price-table form and complete every unit-price field; preparation must also take account of the instructions for management-system document V178. Provide the name, position and contact details of the contract signatory or signatories, the basis for their authority to sign, and the contact person for contract matters. If signing authority does not arise from the articles of association, include a power of attorney. State which information in the bid is claimed as a trade secret and give reasons; the bid price and other information that cannot be classified as confidential under the stated rules may not be designated as trade secrets.
Standard payment periods from receipt of an invoice are 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. If the bidder joins the contracting authority’s factoring programme, the payment period is 95 calendar days. The available documents do not specify the award criteria; check the official tender documents for details.
