Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The contracting authority must exclude a bidder if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; of enabling unlawful employment or breaches of rules on employing foreign nationals in Estonia, including paying below the statutory wage rate; or of unlawful child labour or human trafficking. Exclusion is also required for tax, payment or environmental-charge arrears under the applicable rules, or where awarding the contract would breach an international or Estonian government sanction. The contracting authority may also exclude a bidder for a significant or repeated breach of an essential term of a previous public contract that led to termination, withdrawal, a price reduction, compensation or a contractual penalty. It may exclude a bidder that provided false information about exclusion grounds or compliance with qualification or other requirements, or failed to provide required information or additional documents. The bidder must confirm that no exclusion grounds apply.

Qualification criteria and exclusion grounds

For each of the four lots, the bidder’s average net turnover for the last three completed financial years must be at least EUR 75,000. If the bidder has operated for fewer than three years, turnover is assessed for each year of operation. The bidder must provide turnover information; the contracting authority will verify it against the annual reports in the commercial register. For each lot, the bidder must have completed or be performing at least one contract for winter road snow removal or winter road maintenance during the 48 months before the procurement began. A list of relevant contracts, including their dates and the other contracting parties, must be provided with the bid or at the contracting authority’s request. The bidder must also have, or be able to use during contract performance, the snow-removal equipment required for the relevant area in the technical description. Equipment details must include the make, registration number and basis for use. The bid must be submitted by the bidder’s legal or authorised representative; an authorisation document is required if the signatory is not a board member entered in the register. Joint bidders must appoint a representative and confirm their joint and several liability for contract performance, submitting the authorisation and confirmation with their joint bid. The bidder must confirm acceptance of the procurement documents and compliance with their requirements. The price offer must use the prescribed form and include all costs of performing the contract. Any claimed trade secrets must be identified and justified; the total bid price and lot prices cannot be designated as trade secrets. Where equivalence is relevant, the bidder must explain it and provide supporting evidence; other appropriate evidence may be accepted where the stated legal conditions allow. The supplied documents do not specify an award criterion.
