Compliance requirements
The bidder must confirm that none of the exclusion grounds referred to in § 95(1), points 1–3 and 5 of the Estonian Public Procurement Act apply. The bidder must not be bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, or in another comparable situation, and its business activities must not be suspended. It must have no outstanding national taxes, public charges, environmental charges, tax debts or social security contribution debts. The bidder must demonstrate that the average remuneration of its employees during the six-month reference period exceeded 70% of the average remuneration in the relevant contract sector during the same period. This must be evidenced by an extract from the Estonian Tax and Customs Board or, for a foreign bidder, by evidence from an equivalent competent authority. In a joint tender, evidence must be provided for each joint bidder. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the renovation of the apartment building.
Qualification criteria and exclusion grounds
The bidder must be registered in the economic activities register for construction activities covering general construction, indoor climate systems, and internal or associated water supply and sewerage systems. Where electrical works are performed, the bidder must also be registered for the construction and installation of electrical installations. A foreign bidder may provide equivalent evidence of competence.
The bidder’s net turnover in the financial year preceding the start of the procurement procedure must be at least twice the estimated contract value excluding VAT. By the date of contract signature, or within 10 calendar days after signature at the latest, the bidder must be able to provide a performance security amounting to 5% of the contract value, issued by a credit or financial institution, or deposit the corresponding amount into the beneficiary’s or a notary’s account.
During the 60 months preceding the start of the procurement procedure, the bidder must have completed at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value excluding VAT. The project must have involved construction, extension or full renovation of a building and must have included at least construction or renovation of the building’s load-bearing structures and external envelope, heat-recovery mechanical ventilation, and a new heating system. The bidder must provide project details and either the number of the building register occupancy notice or use permit, or a copy of an acceptance certificate signed by the client and contractor.
The team must include the following qualified persons: a project manager holding at least a level 6 civil engineering qualification or a level 6 construction manager qualification; a site manager holding at least a level 5 construction foreman qualification; a heating and ventilation systems specialist holding at least a relevant level 6 engineering or construction manager qualification; a water supply and sewerage systems specialist holding at least a relevant level 6 engineering or construction manager qualification; for electrical works, a person holding at least a Class B competence certificate or a level 6 electrical engineer qualification; and a level 7 authorised architect responsible for ensuring the project’s compliance with the requirements of the New European Bauhaus. The name and qualification or competence certificate number of each person must be provided. Foreign bidders may use persons with equivalent qualifications.
The bidder must have a quality management system for construction activities meeting at least EVS-EN ISO 9001 and an environmental management system meeting at least EVS-EN ISO 14001 or equivalent requirements. The certificates must be verifiable; where necessary, a certificate copy or other relevant evidence must be submitted.
The tender must comply with all procurement documents; conditional tenders are not permitted. The price tender must be submitted using the beneficiary’s form, together with a joint bidders’ authorisation and an authorised representative’s power of attorney where applicable. Equivalent solutions may be offered for references to products, processes or other solutions, but equivalence must be explained and evidenced in the tender. The bidder must identify any trade secrets or confirm that the tender contains none. If team members are not employees of the bidder or a joint bidder, a written consent from each person confirming participation in contract performance must be submitted.
