Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder will be excluded if the bidder, a member of its administrative, management or supervisory body, or another person authorised to represent, make decisions for or control the bidder has been convicted of participation in a criminal organisation, breach of the duty of integrity, a corrupt act, fraud, a terrorism-related offence, money laundering or terrorist financing. Grounds for exclusion also include convictions for enabling the employment of a foreign national staying in the country unlawfully or breaching the conditions for a foreign national’s employment in Estonia, as well as offences involving the unlawful use of child labour or human trafficking. The bidder must not have outstanding public tax, contribution or environmental charges, or tax or social security contribution debts under the laws of its country of establishment. No contract will be awarded to a bidder where doing so would violate an international sanction or a sanction imposed by the Government of the Republic of Estonia. The bidder must confirm that none of these exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or an equivalent register in its country of establishment where registration is required by law. The contracting authority will check the details of bidders registered in Estonia; a foreign bidder must provide a copy of a valid registration certificate. The bidder and/or its subcontractor must have completed at least one contract for designing fire alarm systems during the 36 months preceding commencement of the procurement, with a total value of at least EUR 20,000. The bidder must submit a list of its most important contracts using Form 1, including contract dates and information about the other parties. If relying on a subcontractor’s reference, the bidder must enter that subcontractor in the subcontractor table in the register so the contracting authority can check its exclusion grounds. The bidder must provide a competent designer who will personally and directly participate in performing the contract. The designer must hold a level 6 professional certificate as a security systems designer and have competence in designing fire alarm systems, or equivalent or higher competence. The bidder must submit the list of responsible specialists using Form 2 and copies of documents proving their competence. A foreign bidder without documents issued under applicable Estonian requirements must provide copies of qualification and competence documents issued under the laws of its country of establishment, and confirm that it will submit confirmation from the Consumer Protection and Technical Regulatory Authority concerning the responsible person’s qualifications and competence within one month after signing the contract. The tender must comply with the tender documents. Alternative, conditional and partial tenders are not permitted. The tender price must follow the prescribed structure. Joint bidders must appoint an authorised representative from among themselves and include a power of attorney.
