Compliance requirements
Exclusion grounds cover a final conviction of the bidder, a member of its management, administrative or supervisory body, or a person with powers of representation for participation in a criminal organisation, corruption, fraud, a terrorist offence or an offence related to terrorist activity, money laundering or terrorist financing, or the use of child labour or human trafficking, within the previous five years, or a continuing exclusion order.
A breach of obligations to pay taxes or social security contributions is also an exclusion ground. In Estonia, the tax authority does not issue a tax-debt certificate if the debt is below EUR 100 or payment has been deferred; for a foreign bidder, the law of its country of establishment applies. Further grounds include enabling a foreign national residing in the country without a legal basis to work, or breaching the conditions for employing a foreign national in Estonia, including paying below the statutory wage rate. A bidder is also excluded if awarding the contract to it would breach an international sanction or a sanction imposed by the Government of Estonia. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must provide at least one road engineer with a Level 6 professional qualification specialising in roads, or a competent person holding a higher-level professional certificate. The contractor must ensure that a team with the necessary competencies is available throughout the contract. The ESPD must state the competent person’s name, qualification and professional certificate number. At the contracting authority’s request, copies of the professional certificate and education document, as well as the responsible person’s confirmation of participation, must be provided; the authority recommends submitting them with the tender. If relying on another entity’s capacity, the bidder must also submit an ESPD for that entity.
During the 36 months preceding the start of the procurement, the bidder must have duly completed at least two service contracts similar to the subject of this contract and involving the installation of road markings. For each contract, provide its subject, dates of conclusion and performance, value excluding VAT, place of work, and the client’s name and contact details; for a public procurement contract, also provide its reference number. The contracting authority recommends including written client confirmations that the work was completed properly.
The tender must comply with the procurement documents; conditional tenders are not permitted. Any equivalence must be explained and supported with evidence. The tender price must follow the prescribed structure and the separately provided quantity table in Annex 2. A joint tender must include a power of attorney for the joint bidders. The available information does not specify the award criteria in detail; these should be checked in the official tender documents.
