Compliance requirements
A bidder must be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of duty, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling unlawful employment or employment-law violations involving foreign nationals; unlawful use of child labour or human trafficking; or tax-related offences. Exclusion is also mandatory where the bidder has outstanding national tax, social security contribution or environmental charge debts, or where awarding the contract would breach international or Estonian government sanctions.
The contracting authority may also exclude a bidder for breaches of environmental, social or labour-law obligations; insolvency, liquidation or suspended business activity; serious professional misconduct; local tax debt; anti-competitive agreements or coordinated conduct; an unmanageable conflict of interest or an advantage arising from involvement in preparing the procurement; significant or persistent failure to perform previous public contracts; false or misleading information; attempts to improperly influence the contracting authority or obtain confidential information; or lack of the legal right to submit a tender. A bidder must provide a declaration confirming that no exclusion grounds apply.
