Compliance requirements

The buyer will exclude a bidder if a ground for exclusion under section 95(1) of Estonia’s Public Procurement Act applies. The bidder must confirm that no such ground applies. Before concluding the framework agreement, the buyer will check this for the successful bidder through the public procurement e-environment and may require supporting evidence before contract signature.

Qualification criteria and exclusion grounds

The bidder, or each member of a joint tender, must be registered in a commercial or similar register under the laws of its country of establishment. If registration is not legally required, the bidder must submit a copy of its founding document or an equivalent document. The bidder must be an officially authorized reseller of the offered product and hold the manufacturer’s authorization to provide technical support in Estonia, including supplying spare parts and carrying out repairs. This must be demonstrated with the manufacturer’s original document or a copy. The tender must include the bidder’s declaration using Form I of Annex 3 and, where applicable, a power of attorney for the bidder’s representative. Joint tenderers must submit a power of attorney for their representative. The tender must remain valid for at least 3 months from the tender submission deadline. For the offered equipment, the bidder must provide a technical description meeting Tables 1 and 2 of Annex 1 and stating the actual value of every parameter. Compliance must be substantiated by manufacturer information, with the relevant evidence pages cited in the compliance table. The bidder must also provide the manufacturer’s information material, an operating manual and a brief description of the offered configuration listing all separately purchased equipment and the hardware and software functions included in the tender. The equipment must be authorized for use in the European Union and bear the CE mark. The bidder must provide evidence that it is a medical device and has undergone conformity assessment under Directive 93/42/EEC or Regulation (EU) 2017/745. Documents must show the device’s risk class and electrical safety class, and these must also be stated in the technical description. Any equivalent solution must be explained and supported by evidence. The manufacturer’s and supplier’s warranty for the equipment must be at least 12 months, and the warranty for spare parts must be at least 3 months. The bidder must provide the precise terms of both warranties, the manufacturer’s technical maintenance requirements and recommendations, including a description of maintenance work, and a price list for repairs and service call-outs using the form in Annex 4. The price list must remain valid throughout the framework agreement. At the time of tender submission, the bidder’s maintenance team must include at least one service engineer who speaks and writes Estonian and has the skills and experience needed to maintain and repair the offered equipment. If requested by the buyer to verify technical characteristics, the bidder must be prepared to deliver a sample to Pärnu Hospital at its own expense within four weeks of the request. The price must be submitted using the form in Annex 4 and include the costs of delivery, installation and configuration of the equipment, as well as training. The offered delivery terms must comply with the tender documents and the draft framework agreement.
