Compliance requirements
The bidder will be excluded if the bidder or a member of its administrative, management or supervisory body, an authorised representative, or another person empowered to represent, make decisions for or control the bidder has been convicted of participation in a criminal organisation, breach of integrity obligations, a corrupt act, fraud, a terrorist offence or another offence related to terrorist activity, money laundering, or terrorist financing. Grounds for exclusion also include convictions for enabling an illegally resident foreign national to work or breaching the conditions for a foreign national’s employment in Estonia, including paying less than the required wage, as well as offences involving the unlawful use of child labour or human trafficking. The bidder must not have outstanding public tax, contribution or environmental charge debts, or tax or social security contribution debts under the laws of its country of establishment.
The contracting authority may also exclude a bidder for a serious or repeated breach of an essential term of a previous public contract if this resulted in termination or withdrawal from the contract, a price reduction, compensation for damage or a contractual penalty. A bidder may also be excluded for providing false information about compliance with the contracting authority’s qualification requirements or for failing to provide required information or additional documents. Companies established in the Russian Federation or the Republic of Belarus may not participate in the procurement.
Qualification criteria and exclusion grounds
Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement. At least one contract must have a value of EUR 40,000 or more, excluding VAT. The bidder must submit a list of contracts showing the performance period, the client representative’s contact details (including telephone number and email address) and, for public contracts, the reference number. The contracting authority may request evidence of proper performance if it cannot obtain the information from public or private databases without significant effort.
The bidder’s team must include a worker with switching rights for a 0.22–1 kV electricity network, registered in Elektrilevi’s partner portal before the tenders are opened. The team must also include a person appointed to be responsible for the work operation, registered in the same portal before the tender submission deadline. At the time of tender submission, the person leading the electrical works must hold valid A-level competence or a qualification at level 6 or above, with supporting evidence, and must be registered in the partner portal before the tender submission deadline.
The tender must comply with the procurement documents; conditional tenders and additional conditions are not permitted. The price table must use the form provided in the procurement documents, and every unit-price field must be completed. The bidder must also take account of the instructions for completing management system document V178. The bidder must provide the name, job title and contact details of the contract signatory, as well as the contact person for contract performance. If the signatory’s authority is not based on the articles of association, a power of attorney must be included.
The contracting authority’s standard payment periods, starting when it receives the invoice, are 14 calendar days for contracts worth up to EUR 59,999; 35 calendar days for contracts worth EUR 60,000–249,999; and 45 calendar days for contracts worth EUR 250,000 or more. Joining the contracting authority’s factoring programme results in a 95-calendar-day payment period.
The bidder must identify any information in its tender that it considers a trade secret and explain the designation. The tender price and figures relating to the award criteria may not be designated as trade secrets. Materials, equipment and goods used in the works, including components, must not be produced in or originate from the Russian Federation or Belarus; the contracting authority may request certificates of origin.
