Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that neither it nor any member of its representative, management or supervisory bodies has, during the past five years or while a disqualification remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal use of child labour or human trafficking. The bidder must also have no outstanding tax or social security contribution debt. The stated threshold for tax debt is EUR 0, although the tax authority does not issue a debt certificate where the debt is below EUR 100 or payment has been deferred. Mandatory grounds also cover enabling a foreign national residing in the country without legal grounds to work, or breaches of the conditions for a foreign national’s employment in Estonia. Awarding the contract must not violate an international or Estonian national sanction, and the bidder must comply with any participation restrictions set out in the tender documents. Where an applicable exclusion ground exists, the bidder may provide evidence of measures taken to restore its reliability if this is permitted for this procurement.

Qualification criteria and exclusion grounds

The bidder must have completed, within the 36 months preceding publication of the contract notice in the national procurement register, at least one contract for owner’s supervision of a public-use building with a gross internal area of at least 2,000 m² and at least one contract for expert examination of the construction design, or a design section, for such a building. Industrial, agricultural and warehouse buildings do not qualify. Contracts begun earlier are acceptable if completed during the specified period; one contract may satisfy both requirements. Provide for each reference the contract subject, building area, client and contact details, and performance period; include the procurement reference number if applicable. The bidder must submit the project manager’s details using Form 2 (CV of the responsible specialist). If the responsible person is employed by an employer not participating in the bid, submit the confirmations of both the responsible person and the employer using Form 3. Joint bidders must appoint an authorised representative and include the power of attorney. The bid must comply with the procurement documents, be unconditional and follow the required price submission structure. Identify and justify any claimed trade secrets; bid prices and other evaluation-related numerical indicators may not be treated as trade secrets. The price is the only award criterion.
