Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded if it, or a person authorised to represent, manage or control it, has a relevant conviction within the previous five years or remains subject to an exclusion period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; agreements that distort competition; an unresolvable conflict of interest; involvement in preparing the procurement that creates an unpreventable competitive advantage; serious or repeated breaches of earlier contracts resulting in early termination, damages, price reductions or penalties; breaches of environmental, social or labour obligations; false or misleading information, failure to provide required information or documents, or improper attempts to influence the procurement or obtain confidential information. National grounds also cover enabling a person without lawful residence to work, contracting with a party in breach of international or national sanctions, and relevant tax offences. For tax and social security debts, the notice describes a zero-euro threshold, while noting that a tax debt under EUR 100 or a debt whose payment has been rescheduled is treated under the applicable tax rules. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

No specific financial, experience or other selection thresholds are stated in the available documents. The bidder must submit a technical description of the proposed equipment covering all requirements in the tender documents, together with the product name, specifications, data sheets and any other information needed to verify compliance. The bid must comply with the tender documents and may not be conditional. If an equivalent product or solution is offered, the equivalence must be explained and supported with evidence where needed. The bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. Where the applicable sanctions regulation applies, the bidder must also confirm that subcontractors and suppliers representing more than 10% of the contract value are not Russian persons or entities, entities more than 50% owned by them, or persons acting on their behalf or under their direction. The bidder must confirm that its place of residence or establishment is not in Russia or Belarus. For a joint bid, the bidders must appoint an authorised representative and include their power of attorney with the bid. The bidder must identify authorised persons who can represent, make decisions for or control the company and are not listed in the relevant register extract, giving their names and personal identification number or date of birth, or confirm that there are no such persons. Any information designated as a trade secret must be identified and the designation justified; the bid price and evaluation-related figures may not be treated as trade secrets.
