Compliance requirements
A bidder must be excluded if it or a relevant representative has been convicted of participation in a criminal organisation, breach of integrity or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling unlawful employment of foreign nationals; or child labour or human trafficking. Exclusion is also mandatory for outstanding state tax, social security or environmental charge debts, or where awarding the contract would breach international or Estonian government sanctions.
The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; bankruptcy, liquidation or a comparable situation; serious professional misconduct; local tax debt; anti-competitive conduct; an unmanageable conflict of interest or distortion of competition arising from involvement in preparing the procurement; serious or repeated failures under previous public contracts; false or misleading information, attempts to improperly influence the authority or obtain confidential information; tax-related offences; or lack of the legal right to submit a bid. A bidder relying on another entity’s resources for technical or professional capacity must also provide the required confirmation that exclusion grounds do not apply to that entity.
Qualification criteria and exclusion grounds
For Parts 1 and 2, the bidder must confirm that it has not materially breached administrative contracts and that no circumstances exist that could lead to its lasting insolvency or cessation of business. All members of a joint bid must meet these requirements; they do not apply to public-law entities. The bidder must provide the required confirmations.
For Parts 1 and 2, the bidder must have, between 1 January 2023 and the date the contract notice was published in the public procurement register, either taught welding as part of formal education or delivered group welding courses totalling at least 300 contact hours. The bidder must submit the prescribed qualification information and indicate whether it relies on another entity’s resources.
For both parts, the training venue must be at the location specified in Appendix 1, section 2, and within a 10-minute walk of an official public transport stop. The bid must include the venue and training-base address. The bidder must name the lecturers, submit the prescribed lecturer information form and copies of documents proving their education, and provide the curriculum using the prescribed form. Lecturer and curriculum requirements are specified in Appendix 1, sections 8 and 7 respectively.
If submitting a joint bid, the bidders must appoint an authorised representative and include the power of attorney. The bidder must identify and justify any information claimed as a trade secret; bid prices and specified evaluation-related figures may not be treated as trade secrets. The bidder must confirm compliance with the tender documents and provide evidence of equivalence where relevant. It must also confirm that contract award and performance would not breach applicable sanctions and that the service will not involve sanctioned persons, goods or services, or items originating from sanctioned territories. The supplied document text does not specify award-scoring criteria; check the official tender documents for any further details.
